【摘要】：從中央到地方出臺的有關(guān)自貿(mào)區(qū)金融創(chuàng)新的法律法規(guī)在立法內(nèi)容上既具有共性又不乏個性,并且革新了監(jiān)管理念和監(jiān)管方式,對我國自貿(mào)區(qū)金融創(chuàng)新的穩(wěn)步發(fā)展發(fā)揮了有目共睹的積極作用。但相關(guān)法律法規(guī)亦存在諸多困境與弊端,主要表現(xiàn)為:嚴(yán)苛的市場準(zhǔn)入制度抑制自貿(mào)區(qū)金融創(chuàng)新的活力,金融業(yè)務(wù)創(chuàng)新立法的滯后滿足不了自貿(mào)區(qū)金融創(chuàng)新實踐所需,以及不健全的風(fēng)險防范機(jī)制難以有效規(guī)制自貿(mào)區(qū)金融創(chuàng)新風(fēng)險。未來我國自貿(mào)區(qū)金融創(chuàng)新立法,應(yīng)朝著制定相對寬松的自貿(mào)區(qū)金融創(chuàng)新市場準(zhǔn)入制度、完善金融業(yè)務(wù)創(chuàng)新規(guī)則以及建立健全自貿(mào)區(qū)金融創(chuàng)新宏觀微觀審慎監(jiān)管體系等三個路徑推進(jìn)。
[Abstract]:The laws and regulations on financial innovation in the FTAZ issued from the central to the local level have both general and unique legislative content, and have revolutionized the concept of supervision and the way of supervision. It has played a positive role in the steady development of financial innovation in China's Free Trade Zone. However, there are many difficulties and drawbacks in the relevant laws and regulations, which are mainly manifested as: strict market access system inhibits the vitality of financial innovation in the FTAZ, and the lag of legislation on financial business innovation cannot meet the needs of the FTAZ's financial innovation practice. And the imperfect risk prevention mechanism is difficult to effectively regulate the risk of financial innovation in FTAZ. In the future, China's free trade zone financial innovation legislation should be oriented towards the establishment of a relatively loose market access system for financial innovation in the free trade zone. Perfecting the rules of financial innovation and establishing and perfecting the macro and micro prudential supervision system of financial innovation in FTAs.
