【摘要】：我國旅游資源管理一直存在諸多問題,旅游資源法律體系建設(shè)不足既是導(dǎo)致這些問題的重要原因,也是改善這些問題的根本手段。旅游資源法律體系建設(shè)既是旅游生態(tài)文明建設(shè)的重要內(nèi)容,也是全面推進(jìn)依法治國、實(shí)現(xiàn)依法興旅與依法治旅的有效途徑�；谖覈F(xiàn)行旅游資源相關(guān)法律法規(guī),結(jié)合旅游資源法律體系建設(shè)環(huán)境,構(gòu)建我國旅游資源法律體系,以《旅游法》為基本法,包括旅游資源保護(hù)制度和旅游資源開發(fā)規(guī)劃制度,由法律、行政法規(guī)、部門規(guī)章、規(guī)范性文件、國家標(biāo)準(zhǔn)、行業(yè)標(biāo)準(zhǔn)、國際公約等多個層次的法律規(guī)范所構(gòu)成。雖然我國旅游資源法律體系已初步形成,但仍存在法律規(guī)定與現(xiàn)實(shí)生活不和諧、法律規(guī)范體系不和諧、法律層次體系不和諧、法律制定與法律實(shí)施不和諧問題。建立內(nèi)外和諧的旅游資源法律體系,需要從適應(yīng)性、系統(tǒng)性、層次性、可適用性四方面完善相關(guān)立法,整合協(xié)調(diào)法律體系內(nèi)外部關(guān)系,健全我國旅游資源法律體系。
[Abstract]:There are many problems in the management of tourism resources in our country. The insufficient construction of the legal system of tourism resources is not only the important reason leading to these problems, but also the fundamental means to improve these problems. The construction of the legal system of tourism resources is not only an important content of the construction of tourism ecological civilization, but also an effective way to promote the rule of law in an all-round way and to realize the development of tourism according to law and the administration of tourism according to law. Based on the current laws and regulations of tourism resources and the construction environment of the legal system of tourism resources, this paper constructs the legal system of tourism resources in China, and takes the Tourism Law as the basic law. It consists of laws, administrative regulations, department regulations, normative documents, national standards, industry standards, international conventions and other legal norms. Although the legal system of tourism resources in China has been initially formed, there are still some problems, such as the disharmony between legal regulations and real life, the disharmony of legal norms system, the disharmony of legal hierarchy system, and the disharmony between the making of laws and the implementation of laws. To establish a harmonious legal system of tourism resources inside and outside, we should perfect the relevant legislation from four aspects: adaptability, systematization, hierarchy and applicability, integrate and coordinate the internal and external relations of the legal system, and perfect the legal system of tourism resources in our country.
