【摘要】：特種設(shè)備安全法律規(guī)制問(wèn)題的研究對(duì)于保障特種設(shè)備安全運(yùn)行,提高工作場(chǎng)所的安全作業(yè)環(huán)境,減少特種設(shè)備安全事故的發(fā)生,保障公民人身健康和財(cái)產(chǎn)安全,維護(hù)良好的社會(huì)秩序具有重要作用。雖然我國(guó)在2014年頒布實(shí)施了《中華人民共和國(guó)特種設(shè)備安全法》(以下簡(jiǎn)稱(chēng)《特種設(shè)備安全法》),特種設(shè)備安全狀況有所好轉(zhuǎn),但是在實(shí)踐中也發(fā)現(xiàn)了不少問(wèn)題。通過(guò)文獻(xiàn)分析法、比較研究法、案例分析法等研究方法對(duì)我國(guó)特種設(shè)備安全法律規(guī)制存在的問(wèn)題進(jìn)行了分析和總結(jié):即特種設(shè)備法律法規(guī)體系尚不健全,雖然在形式上形成了完善的“法律——法規(guī)——規(guī)章——安全技術(shù)規(guī)范——標(biāo)準(zhǔn)”五個(gè)層次的法律法規(guī)體系,但是各個(gè)層次間銜接不順暢、相互矛盾的現(xiàn)象大量存在;互聯(lián)網(wǎng)+、大數(shù)據(jù)時(shí)代的到來(lái),使我國(guó)特種設(shè)備安全監(jiān)管和檢驗(yàn)檢測(cè)已經(jīng)不能適應(yīng)新形勢(shì)的發(fā)展,亟需進(jìn)行改革;社會(huì)公眾參與特種設(shè)備安全管理的機(jī)制尚未建立和完善,未形成社會(huì)合力和多元共治新格局等。依據(jù)法學(xué)相關(guān)理論,并借鑒國(guó)外特種設(shè)備安全法律制度的研究成果,提出應(yīng)當(dāng)從完善與《特種設(shè)備安全法》相配套的行政法規(guī)、規(guī)章、安全技術(shù)規(guī)范、標(biāo)準(zhǔn),推進(jìn)大規(guī)范建設(shè);建立多元合作型監(jiān)管模式,充分發(fā)揮社會(huì)合力;推進(jìn)檢驗(yàn)檢測(cè)機(jī)構(gòu)社會(huì)化改革;建立全國(guó)性的特種設(shè)備安全監(jiān)管系統(tǒng)信息平臺(tái),采取“互聯(lián)網(wǎng)+”安全監(jiān)管方式等方面完善我國(guó)特種設(shè)備安全法律規(guī)制,從而確保特種設(shè)備安全運(yùn)行。
[Abstract]:The study on the legal regulation of the safety of special equipment can ensure the safe operation of special equipment, improve the safe working environment in the workplace, reduce the occurrence of safety accidents of special equipment, and ensure the personal health and property safety of citizens. Maintaining good social order plays an important role. Although China promulgated and implemented the Special equipment Safety Law of the people's Republic of China (hereinafter referred to as "Special equipment Safety Law") in 2014, the safety situation of special equipment has improved, but many problems have been found in practice. Through the methods of literature analysis, comparative research and case analysis, this paper analyzes and summarizes the problems existing in the legal regulation of the safety of special equipment in China: that is, the system of laws and regulations on special equipment is not perfect. Although there is a perfect legal and regulatory system at the five levels of "law-regulation-safety technical norm-standard" in form, the connection between the different levels is not smooth, and there are a lot of contradictory phenomena; With the advent of the Internet and big data era, China's special equipment safety supervision and inspection can not adapt to the development of the new situation, the urgent need for reform; The mechanism of public participation in the safety management of special equipment has not been established and perfected, nor has it formed a new pattern of social resultant force and pluralistic co-management. According to the relevant theory of law and the research results of foreign special equipment safety law system, this paper puts forward that we should perfect the administrative regulations, rules and regulations, safety technical specifications, standards and promote the construction of large-scale norms, which should be matched with the "Special equipment Safety Law". To establish the multi-cooperative supervision mode, to give full play to the social joint forces, to promote the socialization reform of the inspection and testing institutions; In order to ensure the safe operation of special equipment, the information platform of national special equipment safety supervision system is established, and the safety regulation of special equipment in our country is perfected in the aspects of "Internet" safety supervision mode and other aspects, so as to ensure the safe operation of special equipment.
