第三方物流監(jiān)管法律問(wèn)題研究

【摘要】:進(jìn)入21世紀(jì)以后,現(xiàn)代物流行業(yè)得到了快速的發(fā)展,而我們一直使用并存在的第一方物流業(yè)及第二方物流業(yè),他們的組織和管理模式已經(jīng)不能夠滿足當(dāng)今社會(huì)的物流的需求;而且企業(yè)為了提高自己的實(shí)力,以便在與對(duì)手的競(jìng)爭(zhēng)中獲勝,所以加強(qiáng)管理自己的供應(yīng)關(guān)系網(wǎng),并且努力把運(yùn)送商品的成本降到最低,甚至慢慢的把一些不關(guān)鍵的物流活動(dòng)包給另一方。在這種情況下,就產(chǎn)生了第三方物流業(yè),,相比以前從事物流的公司,第三方物流不但針對(duì)性強(qiáng),運(yùn)作成本也很低,而且效率也提到了一個(gè)新的高度,很好的體現(xiàn)了現(xiàn)代社會(huì)的細(xì)致化分工,同時(shí)順應(yīng)了今天的物流產(chǎn)業(yè)的發(fā)展的方向,然而對(duì)第三方物流業(yè)的監(jiān)管還處于起步階段,亟待建立第三方物流的監(jiān)管法律制度。 在2014年9月份頒發(fā)的《物流業(yè)發(fā)展中長(zhǎng)期規(guī)劃從2014年到2020年》中,國(guó)務(wù)院態(tài)度鮮明的表示:在安全方面的監(jiān)督需要強(qiáng)化,加強(qiáng)物流市場(chǎng)的管理力度并使法律體系得到完善。我國(guó)對(duì)第三方物流的監(jiān)管法律尚存在立法滯后甚至空白等問(wèn)題,物流基本法缺位、監(jiān)管體系沒(méi)有真正建立起來(lái),加之沒(méi)有良好的沖突解決機(jī)制,導(dǎo)致對(duì)第三方物流的監(jiān)管難以與第三方物流的迅速發(fā)展同步,出現(xiàn)了許多問(wèn)題,亟待加強(qiáng)物流監(jiān)管法律的完善。 本文首先介紹了我國(guó)第三方物流監(jiān)管法律問(wèn)題的研究背景和意義,進(jìn)而分析了第三方物流的基礎(chǔ)理論。通過(guò)對(duì)第三方物流的目前狀況的分析,引發(fā)了有關(guān)改進(jìn)其法律監(jiān)督管理的議題。同時(shí)從物流監(jiān)管理論分析了建立第三方物流監(jiān)管制度的必要性和可行性,對(duì)美國(guó)和日本第三方物流監(jiān)管進(jìn)行了比較分析,在此基礎(chǔ)上找出值得借鑒的先進(jìn)經(jīng)驗(yàn)和做法。最后,從宏觀和微觀角度分別對(duì)建立我國(guó)第三方物流監(jiān)管制度存在的問(wèn)題進(jìn)行深刻剖析,同時(shí)對(duì)完善第三方物流監(jiān)管法律問(wèn)題提出了合理性建議。
[Abstract]:After entering the 21st century, the modern logistics industry has been developing rapidly, and the first party logistics industry and the second party logistics industry that we have been using and existing, their organization and management mode can no longer meet the needs of the logistics of today's society; And in order to improve their own strength in order to win the competition with their competitors, companies have strengthened their supply network and tried to minimize the cost of transporting goods. Even slowly some of the key logistics activities to the other party. In this case, the third-party logistics industry has emerged. Compared with the former logistics companies, the third-party logistics not only has strong pertinence, but also has very low operating costs, and its efficiency has also been raised to a new height. It reflects the meticulous division of labor in modern society and conforms to the direction of the development of logistics industry today. However, the supervision of third-party logistics industry is still in its infancy, and it is urgent to establish a regulatory legal system of third-party logistics. In the medium- and long-term plan for the development of the logistics industry from 2014 to 2020, issued in September 2014, the State Council said clearly that supervision on safety should be strengthened, the management of the logistics market should be strengthened, and the legal system should be improved. In our country, there are still some problems such as legislation lag or even blank in the supervision law of third party logistics, the basic law of logistics is absent, the supervision system has not really been established, and there is no good conflict resolution mechanism. As a result, the supervision of third party logistics is difficult to keep pace with the rapid development of third party logistics, there are many problems, it is urgent to strengthen the improvement of logistics supervision law. This paper first introduces the research background and significance of the third party logistics supervision in China, and then analyzes the basic theory of third party logistics. Through the analysis of the current situation of third party logistics, it leads to the issue of improving its legal supervision and management. At the same time, this paper analyzes the necessity and feasibility of establishing the supervision system of the third party logistics from the theory of logistics supervision, and makes a comparative analysis of the third party logistics supervision in the United States and Japan, and on this basis, finds out the advanced experiences and practices that are worthy of reference. Finally, from the macro and micro point of view, this paper deeply analyzes the problems existing in the establishment of the third party logistics supervision system in China, and at the same time puts forward some reasonable suggestions to perfect the third party logistics supervision law.
