【摘要】：馬航MH370失聯(lián)事件已經(jīng)過去整整兩年,然而家屬索賠依舊處于爭(zhēng)議和模糊的狀態(tài)。如何建立中國國情下的空難理賠體系,完善現(xiàn)有索賠程序的不足,從而與法制發(fā)達(dá)國家接軌,是我國現(xiàn)階段空難理賠所關(guān)注的重點(diǎn)。本文以馬航MH370事件為切入點(diǎn),通過中外空難理賠制度的對(duì)比,分析我國現(xiàn)有空難理賠體系的缺點(diǎn),并提出了完善方略和建立構(gòu)想。
[Abstract]:Exactly two years have passed since the disappearance of Malaysia Airlines MH370, but family claims remain controversial and vague. How to set up the air accident claim system under the national conditions of China, perfect the deficiency of the existing claim procedure, so as to connect with the developed country of legal system, is the focus of our country's air accident claim settlement at the present stage. Based on the MH370 incident of Malaysia Airlines, this paper analyzes the shortcomings of the existing air accident claim system in China through the comparison between the Chinese and foreign air accident claim systems, and puts forward the improvement strategy and the establishment idea.
