【摘要】：交船與還船雖為光船租賃合同的對(duì)應(yīng)性履行行為,但在法律判定標(biāo)準(zhǔn)上有所不同。交船遵循債的履行原理,以出租人"實(shí)際履行"交船義務(wù)作為判定標(biāo)準(zhǔn);還船則遵循物權(quán)保護(hù)原理,以承租人還船時(shí)"回復(fù)"船舶物權(quán)作為判定標(biāo)準(zhǔn)。對(duì)二者"甄別性"地對(duì)待,有利于合同雙方利益的公平合理的分配。
[Abstract]:Delivery of ship and return of ship is the corresponding performance of bareboat charter contract, but it is different in the standard of legal judgment. The delivery of ships follows the principle of debt performance, taking the shipowner's "actual performance" of the ship's obligation as the judgment standard, while the ship's return follows the principle of real right protection, and the charterer's "recovery" of the ship's real right is taken as the criterion. It is beneficial to the fair and reasonable distribution of the interests of both parties to the contract.
