【摘要】：反壟斷法不僅為了維護自由、公平的競爭,還要促進、提升市場經(jīng)濟的效率,因此對于壟斷之利和反壟斷中蘊涵的辯證法,必須明察。反壟斷法是合理性與合法性高度統(tǒng)一、充分講"理"的一種法�！斗磯艛喾ā芳捌錀l文,只是為判斷一種行為是否合乎市場經(jīng)濟的要求提供一種分析的框架或方法,其有效實現(xiàn)高度依賴于整個社會形成恰當?shù)氖袌鼋?jīng)濟理念;同時,還要善于在反壟斷法的框架下作細致、周全的"經(jīng)濟學(xué)"分析。
[Abstract]:Anti-monopoly law is not only to safeguard freedom and fair competition, but also to promote and improve the efficiency of market economy. Therefore, the interests of monopoly and the dialectics contained in anti-monopoly must be clearly observed. Anti-monopoly law is a kind of law which is highly unified in rationality and legitimacy. The Anti-monopoly Law and its provisions provide an analytical framework or method for judging whether an act conforms to the requirements of market economy. Its effective realization highly depends on the whole society to form the proper market economy idea, at the same time, it should be good at making the detailed and thorough "economics" analysis under the frame of the anti-monopoly law.
