【摘要】：招投標(biāo)中職務(wù)犯罪存在如下特點(diǎn):操縱標(biāo)的、"班子會(huì)"定標(biāo)、評(píng)標(biāo)形式化。究其原因有二:一是"隱形"權(quán)力干擾;二是招投標(biāo)制度問題。在招投標(biāo)領(lǐng)域開展職務(wù)犯罪預(yù)防無疑是"防患于未然"的必然之舉。招投標(biāo)領(lǐng)域職務(wù)犯罪具有特殊性,因此開展職務(wù)犯罪預(yù)防也要采取有針對(duì)性的策略。首先要健全權(quán)力責(zé)任制度,建立多元化的權(quán)力追責(zé)制度,由組織部門牽頭,采用紀(jì)檢、監(jiān)察、檢察等多部門聯(lián)席會(huì)的形式,針對(duì)具體情況追究領(lǐng)導(dǎo)的政治責(zé)任、經(jīng)濟(jì)責(zé)任、道德責(zé)任、刑事責(zé)任;其次要開展職務(wù)犯罪預(yù)防監(jiān)督介入,確保程序公正公平。
[Abstract]:The crime of duty in bidding has the following characteristics: manipulating the target, "the team will" set the standard, and formalizing the evaluation of the bid. There are two reasons: one is "invisible" power interference, the other is bidding system. It is inevitable to carry out duty crime prevention in bidding field. The duty crime in bidding field has its particularity, so it is necessary to adopt targeted strategies to prevent it. First of all, we should improve the system of power and responsibility, establish a pluralistic system of power and accountability, take the lead by the organizational departments, adopt the form of discipline inspection, supervision, and procuratorial meetings, and investigate the political and economic responsibilities of leaders in the light of specific circumstances. Moral responsibility, criminal responsibility; secondly, duty crime prevention, supervision and intervention to ensure fair procedures.
