網(wǎng)約車市場(chǎng)準(zhǔn)入問(wèn)題研究

【摘要】:在移動(dòng)互聯(lián)網(wǎng)技術(shù)與傳統(tǒng)行業(yè)融合發(fā)展的背景下,我國(guó)產(chǎn)生了一種以信息平臺(tái)化和共享經(jīng)濟(jì)為特征的交通新業(yè)態(tài)——網(wǎng)約車。網(wǎng)約車服務(wù),不僅迎合了市民的出行需求,而且開(kāi)辟了新的服務(wù)領(lǐng)域。但是,網(wǎng)約車的出現(xiàn)給傳統(tǒng)出租車市場(chǎng)帶來(lái)了較大影響,伴隨網(wǎng)約車發(fā)展的是社會(huì)各界爭(zhēng)議。因此,網(wǎng)約車市場(chǎng)準(zhǔn)入問(wèn)題也成為現(xiàn)行道路運(yùn)輸市場(chǎng)亟待解決的重要問(wèn)題。目前,在筆者所見(jiàn)的諸多研究資料中,有較多文獻(xiàn)討論了法制視角下網(wǎng)約車的合法性問(wèn)題,但少有涉及網(wǎng)約車的市場(chǎng)準(zhǔn)入問(wèn)題。本文以此為切入點(diǎn),圍繞網(wǎng)約車該不該市場(chǎng)準(zhǔn)入展開(kāi)討論。由于網(wǎng)約車市場(chǎng)準(zhǔn)入問(wèn)題的理論性、政策性和實(shí)踐性都很強(qiáng),本文在對(duì)我國(guó)運(yùn)輸市場(chǎng)準(zhǔn)入理論研究的基礎(chǔ)上,通過(guò)參考國(guó)內(nèi)外部分城市汽車預(yù)約服務(wù)經(jīng)營(yíng)模式的相關(guān)文獻(xiàn),結(jié)合交通運(yùn)輸部的會(huì)議文件精神,從理論層面對(duì)網(wǎng)約車市場(chǎng)準(zhǔn)入問(wèn)題做出以下幾個(gè)方面的研究。首先,本文從網(wǎng)約車服務(wù)的概念展開(kāi)討論,對(duì)網(wǎng)約車的特征、類型、產(chǎn)生原因以及面臨的現(xiàn)實(shí)困境作簡(jiǎn)要介紹。其次,在梳理運(yùn)輸市場(chǎng)準(zhǔn)入相關(guān)概念的基礎(chǔ)上,闡述了我國(guó)當(dāng)前網(wǎng)約車市場(chǎng)準(zhǔn)入現(xiàn)狀及主要影響因素,說(shuō)明現(xiàn)行網(wǎng)約車行業(yè)還未建立起一套完整的市場(chǎng)準(zhǔn)入制度。最后,通過(guò)采用資料分析、對(duì)比分析等研究方法對(duì)國(guó)外有關(guān)實(shí)踐經(jīng)驗(yàn)分析得出網(wǎng)約車市場(chǎng)準(zhǔn)入管制的啟示,進(jìn)而對(duì)我國(guó)網(wǎng)約車市場(chǎng)準(zhǔn)入主體、準(zhǔn)入基本條件、準(zhǔn)入程序、準(zhǔn)入方式等幾方面進(jìn)行了詳細(xì)論述,并提出了自己的一些建議。
[Abstract]:Under the background of the convergence of mobile Internet technology and traditional industry, a new traffic mode, named car-sharing, which is characterized by information platform and sharing economy, has emerged in China. Ride-hailing service not only caters to the public's travel demand, but also opens up a new service field. However, the emergence of net-ride-hailing has brought great influence to the traditional taxi market, with the development of net-ride-sharing, which is controversial from all walks of life. Therefore, the issue of market access for ride-sharing has become an important issue to be solved in the current road transport market. At present, among the many research materials the author has seen, there are many documents discussing the legality of the net ride-sharing under the legal perspective, but few of them are concerned with the market access of the net-ride-hailing. This article as a starting point, around the net car market access should not be discussed. Due to the strong theoretical, policy and practical nature of the market access problem, this paper, on the basis of the theoretical study of China's transport market access, refers to the relevant documents of some cities at home and abroad on the operation mode of automobile reservation service. Combined with the spirit of the conference documents of the Ministry of Transport, this paper makes the following research on the issue of market access in terms of theory. Firstly, this paper discusses the concept of ride-hailing service, and briefly introduces the characteristics, types, causes and practical difficulties of net-ride-hailing service. Secondly, on the basis of combing the related concepts of transport market access, this paper expounds the current market access situation and main influencing factors in China, and explains that the current market access system has not been established. Finally, by means of data analysis, comparative analysis and other research methods, the author draws the enlightenment of the regulation of ride-sharing market access in foreign countries, and then gives the main body, basic conditions and procedures of market access to China's net-ride-hailing market. Access methods and other aspects of the detailed discussion, and put forward some suggestions.
