【摘要】：互聯(lián)網(wǎng)反壟斷司法規(guī)制是反壟斷研究中的新命題。通過對(duì)15份互聯(lián)網(wǎng)壟斷行為案件司法裁判文書的統(tǒng)計(jì)分析,發(fā)現(xiàn)目前我國互聯(lián)網(wǎng)反壟斷司法規(guī)制主要存在四大困境:互聯(lián)網(wǎng)反壟斷法律體系不健全、法院缺乏案件審判經(jīng)驗(yàn)、原被告法律地位不對(duì)等以及互聯(lián)網(wǎng)技術(shù)性問題難以應(yīng)對(duì)�；饫Ь硲�(yīng)完善互聯(lián)網(wǎng)反壟斷法律法規(guī)體系,彌補(bǔ)法律漏洞;強(qiáng)化審判組織建設(shè),逐步提升司法審判隊(duì)伍的專業(yè)素養(yǎng);構(gòu)建公平合理的舉證責(zé)任制度,矯正訴辯格局的失衡;采用綜合行為認(rèn)定標(biāo)準(zhǔn),化解技術(shù)性審判障礙。此外,互聯(lián)網(wǎng)反壟斷司法規(guī)制還需注意把握規(guī)制力度,防止司法能動(dòng)過度,平衡司法規(guī)制與政策性保護(hù)以促進(jìn)產(chǎn)業(yè)發(fā)展,結(jié)合豁免制度的適用以激勵(lì)行業(yè)創(chuàng)新。
[Abstract]:Internet anti-monopoly judicial regulation is a new proposition in anti-monopoly research. Based on the statistical analysis of 15 judicial adjudication documents of Internet monopoly cases, it is found that there are four main difficulties in the judicial regulation of Internet antimonopoly in China: the imperfect legal system of Internet antimonopoly and the lack of court experience in adjudicating cases. The original defendant legal status is not equal and the Internet technical problems are difficult to deal with. To resolve the dilemma, we should perfect the system of Internet antitrust laws and regulations, make up the legal loophole; strengthen the construction of trial organization, gradually improve the professional quality of the judicial team; construct a fair and reasonable burden of proof system, correct the imbalance of the pattern of prosecution and defense; Adopt the standard of comprehensive behavior to resolve the technical obstacle of trial. In addition, Internet anti-monopoly judicial regulation should also pay attention to grasp the regulation dynamics, prevent excessive judicial initiative, balance judicial regulation with policy protection to promote industrial development, and combine the application of exemption system to stimulate industry innovation.
