【摘要】:在西方社會(huì)中,城市規(guī)劃中的公眾參與自二十世紀(jì)60年代開始成為城市規(guī)劃進(jìn)一步發(fā)展的重要內(nèi)容,此后也成為了城市規(guī)劃不可或缺的主動(dòng)力。但對(duì)我國(guó)而言,長(zhǎng)期以來(lái)城市規(guī)劃基本上是以政府為主導(dǎo)自上而下進(jìn)行的,城市的建設(shè)和更新都是在政府及其規(guī)劃建設(shè)管理部門主導(dǎo)下運(yùn)作的,除了政府和規(guī)劃管理及其相關(guān)部門以外,其他部門則較少參與其中,至于在城市規(guī)劃中公眾主動(dòng)行使參與權(quán)更是無(wú)從談起。隨著市場(chǎng)經(jīng)濟(jì)和民主政治的發(fā)展,公眾的自主意識(shí)不斷增強(qiáng),激發(fā)了公眾的政治參與熱情,在行政領(lǐng)域這一現(xiàn)象體現(xiàn)得尤為明顯。在行政活動(dòng)過程中,通過允許、鼓勵(lì)私權(quán)利一方參與行政運(yùn)行,提升行政活動(dòng)的公開性和公正性,促使政府與社會(huì)大眾的意愿相互協(xié)調(diào)和良性互動(dòng),這已成為新行政法視野下的發(fā)展趨勢(shì)和正當(dāng)性標(biāo)準(zhǔn)之一。尤其是在城市規(guī)劃,這樣一種技術(shù)性、前瞻性與政治政策性并重的行政領(lǐng)域,公眾參與權(quán)的行使不僅僅是一種理念或期盼,更應(yīng)該是一種體系構(gòu)建和制度創(chuàng)新。城市規(guī)劃的長(zhǎng)期性、專家模式、未來(lái)預(yù)設(shè)等功能,對(duì)公眾參與權(quán)的行使提出了更高程度的要求。它對(duì)社會(huì)、城市發(fā)展的影響是具有普遍意義的。我國(guó)《城鄉(xiāng)規(guī)劃法》在大約八個(gè)條款中規(guī)定了公眾參與,但多數(shù)還是彈性條款,在整個(gè)規(guī)劃過程中,一些關(guān)鍵的規(guī)劃程序并沒有保證利害關(guān)系人的參與規(guī)定。本文從理論和法律制度兩個(gè)層面對(duì)公眾參與權(quán)進(jìn)行探究:第一部分,城市規(guī)劃中公眾參與權(quán)的基礎(chǔ)理論。在這部分筆者通過對(duì)公眾參與的含義、公眾參與權(quán)的含義、特點(diǎn)、構(gòu)成要件及價(jià)值進(jìn)行分析。第二部分,城市規(guī)劃中公眾參與權(quán)的現(xiàn)狀及其原因分析。本部分對(duì)我國(guó)有關(guān)公眾行使參與權(quán)的法律規(guī)定進(jìn)行梳理并對(duì)實(shí)際運(yùn)行中的問題進(jìn)行剖析。第三部分,完善城市規(guī)劃中公眾參與權(quán)的法律保障。本部分針對(duì)公眾在城市規(guī)劃中行使參與權(quán)存在的問題,從立法規(guī)制、法律程序、組織機(jī)構(gòu)、救濟(jì)制度等方面提出客觀理性的建議。
[Abstract]:In western society, public participation in urban planning has become an important part of the further development of urban planning since the 1960s, and has become an indispensable driving force of urban planning since then. However, for a long time in China, urban planning has been basically government-led and top-down, and the construction and renewal of cities have been operated under the guidance of the government and its planning and construction management departments. In addition to the government and planning management and related departments, other departments are less involved in urban planning, as for the public initiative to exercise the right to participate in urban planning is not possible. With the development of market economy and democratic politics, the public's consciousness of independence has been strengthened constantly, which has aroused the enthusiasm of the public's political participation, especially in the administrative field. In the process of administrative activities, by encouraging the private right party to participate in the administrative operation, to promote the openness and fairness of the administrative activities, and to promote the mutual coordination and benign interaction between the government and the public. This has become the new administrative law under the development trend and legitimacy of one of the standards. Especially in the administrative field of urban planning, which is technical, forward-looking and political policy, the exercise of public participation right is not only a kind of idea or expectation, but also a system construction and system innovation. The long-term urban planning, expert model, future presupposition and other functions put forward higher requirements for the exercise of public participation right. Its influence on social and urban development is of universal significance. The Urban and Rural Planning Law of China provides for public participation in about eight articles, but most of them are flexible clauses. In the whole planning process, some key planning procedures do not guarantee the participation of interested parties. This paper probes into the right of public participation from two aspects of theory and legal system: the first part is the basic theory of public participation right in urban planning. In this part, the author analyzes the meaning of public participation, the meaning, characteristics, elements and value of public participation right. The second part, the present situation and the reason analysis of public participation right in urban planning. This part combs the laws and regulations about the public's right to participate and analyzes the problems in practice. The third part, perfect the legal protection of public participation right in urban planning. Aiming at the problems of public participation in urban planning, this part puts forward some objective and rational suggestions from the aspects of legislative regulation, legal procedure, organization, relief system and so on.
