【摘要】：商人責(zé)任這一命題,內(nèi)涵雋永,不同學(xué)科領(lǐng)域定位迥異,即使在法學(xué)視域中,也難以形成對(duì)其邊界的統(tǒng)一厘清。商人應(yīng)當(dāng)擔(dān)負(fù)多大范圍的責(zé)任,是應(yīng)與自然人一樣只要做守法公民"不違法"即可太平無(wú)事,皆大歡喜,抑或是肩負(fù)更為積極、寬廣的社會(huì)責(zé)任?在商人觸犯法律時(shí),是應(yīng)當(dāng)與普通民事主體一樣承擔(dān)補(bǔ)償性民事責(zé)任,抑或與之區(qū)別,進(jìn)而承擔(dān)相較更為嚴(yán)苛的懲罰性商事責(zé)任?毋庸置疑,面對(duì)著復(fù)雜多變的市場(chǎng)經(jīng)濟(jì),面對(duì)著唯利是圖、為富不仁現(xiàn)象的出現(xiàn),不得不讓人們急迫地、認(rèn)真地去深刻反思商人責(zé)任的這兩個(gè)"度量問(wèn)題",前者稱(chēng)之為商人責(zé)任的"維度",后者稱(chēng)之為商人責(zé)任的"深度"。
[Abstract]:The proposition of businessman's responsibility has a meaningful connotation, and the orientation of different disciplines is very different. Even in the field of law, it is difficult to unify and clarify its boundary. What extent of responsibility should businessmen bear?. Should they, like natural persons, be "law-abiding" citizens to be peaceful and happy, or should they shoulder more active and broad social responsibilities?. When the businessman violates the law, should he assume the compensatory civil liability as the ordinary civil subject, or should he bear the more severe punitive commercial liability? There is no doubt that in the face of a complex and changeable market economy, facing the appearance of profit-seeking and inconsiderate phenomena, people have to make it urgent. The former is called the "dimension" of the responsibility of the businessman, and the latter is called the "depth" of the responsibility of the businessman.
