【摘要】:互聯(lián)網(wǎng)領(lǐng)域的不正當(dāng)競爭是現(xiàn)實(shí)世界傳統(tǒng)市場競爭在網(wǎng)絡(luò)領(lǐng)域的延伸,由于互聯(lián)網(wǎng)自身所具有的特點(diǎn)和性質(zhì),例如數(shù)字化、匿名性、虛擬性和外放性等,網(wǎng)絡(luò)領(lǐng)域的不正當(dāng)競爭表現(xiàn)出不同于現(xiàn)實(shí)世界傳統(tǒng)市場不正當(dāng)競爭的特有的表現(xiàn)形式和特點(diǎn)。由于互聯(lián)網(wǎng)的普及和大眾對(duì)互聯(lián)網(wǎng)的依賴性日益提高,互聯(lián)網(wǎng)領(lǐng)域的不正當(dāng)競爭給普通消費(fèi)者帶來的侵害和社會(huì)主義市場經(jīng)濟(jì)秩序的沖擊越來越明顯。為了保障社會(huì)主義市場經(jīng)濟(jì)和互聯(lián)網(wǎng)領(lǐng)域經(jīng)濟(jì)秩序的平穩(wěn)發(fā)展和持續(xù)繁榮,我們國家很有必要加強(qiáng)對(duì)互聯(lián)網(wǎng)領(lǐng)域不正當(dāng)競爭的法律規(guī)制;ヂ(lián)網(wǎng)在中國的發(fā)展歷史不是很長,所以相對(duì)來說我國對(duì)于互聯(lián)網(wǎng)領(lǐng)域商業(yè)規(guī)制的經(jīng)驗(yàn)不是很豐富,可以適用的規(guī)制相關(guān)行為的法律規(guī)范也不是很完善。市場經(jīng)濟(jì)國家的“經(jīng)濟(jì)憲法”和“自由企業(yè)憲章”——反不正當(dāng)競爭法是規(guī)范市場經(jīng)濟(jì)國家的市場經(jīng)濟(jì)秩序的不可或缺的基礎(chǔ)性法律。而我國的《反不正當(dāng)競爭法》是在以規(guī)范傳統(tǒng)的市場經(jīng)濟(jì)秩序?yàn)楸尘暗臈l件下制定頒布的,其對(duì)于現(xiàn)代市場經(jīng)濟(jì)不正當(dāng)競爭的新的表現(xiàn)形式,即互聯(lián)網(wǎng)領(lǐng)域內(nèi)的不正當(dāng)競爭的規(guī)范暴露出來一定的弊端,調(diào)整范圍有限,亟需進(jìn)行一定的完善。此外,我國與《反不正當(dāng)競爭法》相配套的規(guī)范制度也不是很健全,因此健全相關(guān)的配套制度,對(duì)于完善我國現(xiàn)代市場經(jīng)濟(jì)秩序也起到很重要的作用。本文大致分為四個(gè)部分,第一部分對(duì)網(wǎng)絡(luò)不正當(dāng)競爭行為的概念進(jìn)行界定,給出了網(wǎng)絡(luò)不正當(dāng)競爭行為的一般構(gòu)成要件,并歸納其特征主要包括虛擬性、匿名性、廣域性、獨(dú)立性、共享性、交互性、即時(shí)性、平等性等;第二部分對(duì)我國網(wǎng)絡(luò)不正當(dāng)競爭行為的規(guī)制現(xiàn)狀進(jìn)行分析并提出其存在的問題:我國《反不正當(dāng)競爭法》主要存在規(guī)定過于原則性、規(guī)制主體存在限制等問題;其他對(duì)網(wǎng)絡(luò)不正當(dāng)競爭行為進(jìn)行規(guī)范的法律文件中也存在一些問題,如對(duì)商標(biāo)法的適用不充分、立法存在一定的滯后性等;第三部分主要介紹國外主要國家和國際層面對(duì)不正當(dāng)競爭行為的規(guī)制以及我國可以借鑒的經(jīng)驗(yàn),主要包括西方主要國家對(duì)于不正當(dāng)競爭行為的規(guī)制,如德國《反不正當(dāng)競爭法》、日本《不正當(dāng)競爭防止法》等。另外,還介紹了國際層面對(duì)不正當(dāng)競爭行為的規(guī)制,如《歐盟商標(biāo)指令》、《保護(hù)工業(yè)產(chǎn)權(quán)巴黎公約》等;最后一部分提出解決方案,一方面從立法、行政等方面對(duì)我國網(wǎng)絡(luò)不正當(dāng)競爭行為的規(guī)制進(jìn)行補(bǔ)充,另一方面針對(duì)域名范圍不正當(dāng)競爭行為和惡意軟件領(lǐng)域內(nèi)的不正當(dāng)競爭行為的特殊性給出相應(yīng)的完善對(duì)策。
[Abstract]:The unfair competition in the field of the Internet is the extension of the traditional market competition in the real world. Because of the characteristics and properties of the Internet itself, such as digitalization, anonymity, virtuality and extroversion, etc. The unfair competition in the network field is different from the traditional market in the real world. Due to the popularity of the Internet and the increasing dependence of the public on the Internet, the unfair competition in the field of the Internet has brought more and more obvious damage to the ordinary consumers and the impact of the socialist market economic order. In order to ensure the smooth development and sustainable prosperity of the socialist market economy and the economic order in the field of Internet, it is necessary for our country to strengthen the legal regulation of unfair competition in the field of Internet. The history of Internet development in China is not very long, so the experience of commercial regulation in the field of Internet in China is not very rich, and the applicable legal norms of regulating related behavior are not very perfect. "Economic Constitution" and "Charter of Free Enterprise" of Market economy countries-Anti-unfair Competition Law is an indispensable basic law to regulate the order of market economy in market economy countries. The Anti-unfair Competition Law of our country was formulated and promulgated under the background of standardizing the traditional market economic order, which is a new manifestation of unfair competition in the modern market economy. The regulation of unfair competition in the field of Internet exposed some drawbacks, limited range of adjustment, and needed to be improved. In addition, our country and "Anti-unfair Competition Law" matching standard system is not very sound, so the perfect supporting system, to improve our modern market economic order also plays a very important role. This paper is divided into four parts. The first part defines the concept of network unfair competition behavior, gives the general elements of network unfair competition behavior, and summarizes its characteristics, including virtual, anonymous, wide area. Independence, sharing, interactivity, immediacy, equality, etc. The second part analyzes the current situation of the regulation of network unfair competition in our country and puts forward the existing problems: the main provisions of Anti-unfair Competition Law in China are too principled and the regulation subject is limited. There are also some problems in other legal documents that regulate the unfair competition behavior of the network, such as the inadequate application of trademark law, the existence of lag in legislation and so on; The third part mainly introduces the foreign countries and the international level of the regulation of unfair competition behavior and China can learn from the experience, including the main western countries on the regulation of unfair competition behavior. For example, Germany, anti-unfair competition law, Japan, unfair competition prevention law, and so on. In addition, it also introduces the international regulation of unfair competition, such as the EU Trademark Directive, the Paris Convention for the Protection of Industrial property, and so on. On the other hand, the author puts forward the corresponding perfect countermeasures in view of the particularity of the domain name scope unfair competition behavior and the malware field unfair competition behavior in our country network unfair competition behavior regulation, and so on, carries on the supplement to our country network unfair competition behavior, on the other hand, proposes the corresponding consummation countermeasure.
