【摘要】:最近幾年,互聯(lián)網(wǎng)專車不斷發(fā)展壯大;ヂ(lián)網(wǎng)專車是以互聯(lián)網(wǎng)技術(shù)為基礎(chǔ),先由打車軟件平臺(tái)收入非出租車輛和乘客的信息并整合,然后由乘客在專車平臺(tái)發(fā)出預(yù)定消息后、非出租車輛在平臺(tái)上接單、將乘客按約定路線送至目的地后,乘客通過(guò)專車平臺(tái)支付報(bào)酬的一種新型服務(wù)形式。作為一種新興業(yè)態(tài),互聯(lián)網(wǎng)專車彌補(bǔ)了城市公共交通和出租車運(yùn)力的不足,在很大程度上方便了人們的生活。而作為一種門檻低、時(shí)間靈活的賺取外快模式,大量私家車車主加入網(wǎng)約車行列。但關(guān)于網(wǎng)約車是否合法的問題,一直爭(zhēng)議不斷。于是2016年7月28日出臺(tái)的《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營(yíng)服務(wù)管理暫行辦法》規(guī)定了私家車和私家車主的合理的準(zhǔn)入條件,并規(guī)定由服務(wù)地主管部門按條件審核后,給私家車和私家車主發(fā)放《網(wǎng)絡(luò)預(yù)約出租汽車運(yùn)輸證》和《網(wǎng)絡(luò)預(yù)約出租汽車駕駛員證》。既規(guī)范了私家車和私家車主的準(zhǔn)入條件,又給予加入專車行列的私家車和私家車主合法身份、給了互聯(lián)網(wǎng)專車合法身份。但雖然有《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營(yíng)服務(wù)管理暫行辦法》對(duì)網(wǎng)約車的合法地位進(jìn)行認(rèn)定,在網(wǎng)約車運(yùn)營(yíng)過(guò)程中,還存在許多法律問題,如主體間法律關(guān)系不明確及法律責(zé)任主體不清晰等。本文通過(guò)案例提出這些問題,并著重分析了三種專車模式下各方主體間合同關(guān)系,以此來(lái)分析在發(fā)生侵權(quán)情況時(shí)各方主體的法律責(zé)任。作者希望通過(guò)本文,對(duì)尚不完善的互聯(lián)網(wǎng)專車立法提出補(bǔ)充。本文共分為五個(gè)部分。第一章是對(duì)互聯(lián)網(wǎng)專車的概述,包括互聯(lián)網(wǎng)專車法律性質(zhì)分析和三種專車模式的概述;第二章是通過(guò)對(duì)專車典型案例的分析提出了互聯(lián)網(wǎng)專車運(yùn)營(yíng)中存在法律關(guān)系不清晰、責(zé)任主體不明確、專車乘客權(quán)益難保護(hù)等問題。第三章通過(guò)對(duì)三種專車模式下各方主體間合同關(guān)系分析明確了各種模式合同主客屬性。第四章分析了互聯(lián)網(wǎng)專車乘客受損害之法律責(zé)任主體,明確了乘客受損害之侵權(quán)責(zé)任主體。第五章提出了對(duì)互聯(lián)網(wǎng)專車乘客權(quán)益保護(hù)的對(duì)策思考,包括健全立法、針對(duì)區(qū)域情況確定責(zé)任的具體劃分、轉(zhuǎn)變管理方式等,切實(shí)保障專車乘客權(quán)益。最后是對(duì)全篇的總結(jié)。
[Abstract]:In recent years, the Internet private car continues to grow. Internet special cars are based on Internet technology. First, the taxi-hailing software platform collects and integrates the information of non-rental vehicles and passengers, and then after the passengers issue a predetermined message in the private car platform, the non-rental vehicles receive orders on the platform. A new form of service in which passengers are paid for via a special-car platform after they are sent to their destination on an agreed route. As a new form of business, Internet private cars make up for the shortage of urban public transport and taxi transport capacity, and to a large extent facilitate people's lives. As a low threshold, flexible time to earn extra-income mode, a large number of private car owners to join the ranks. However, there has been a constant controversy about the legality of ride-sharing. Thus, on July 28, 2016, the "interim measures for the Administration of online booking Taxi Business Service" stipulated reasonable access conditions for private cars and private car owners, and stipulated that the competent authorities of the place of service shall examine and verify the conditions according to the conditions. To issue private cars and private car owners the online booking taxi transport license and the network booking taxi driver's license. It not only standardizes the entry conditions of private cars and private car owners, but also gives legal status to private cars and private car owners who join the ranks of private cars, and gives legal status to Internet private cars. However, although there are "interim measures on the Management of online booking Taxi Business Services" to determine the legal status of the Net-Training, there are still many legal problems in the course of the operation of the Net-chartered car. For example, the legal relationship between subjects is unclear and the subject of legal responsibility is unclear. This paper puts forward these problems through the case, and emphatically analyzes the contractual relationship between the parties under the three kinds of special car mode, so as to analyze the legal liability of the parties in the case of infringement. Through this article, the author hopes to make a supplement to the imperfect legislation of Internet special car. This paper is divided into five parts. The first chapter is an overview of the Internet special car, including the analysis of the legal nature of the Internet special car and the overview of the three modes of the special car. Chapter two is based on the analysis of the typical cases of the special car, and points out that the legal relationship in the operation of the Internet special car is not clear. The responsibility of the main body is unclear, the rights and interests of special bus passengers are difficult to protect and so on. The third chapter analyzes the relationship between the parties under the three kinds of special vehicle mode and clarifies the subjective and objective attributes of the various modes. The fourth chapter analyzes the subject of legal liability for the damage to the passengers of the Internet special bus, and clarifies the subject of tort liability for the damage to the passengers. The fifth chapter puts forward the countermeasures of protecting the rights and interests of Internet special bus passengers, including improving legislation, determining the specific division of responsibilities in view of regional conditions, changing management methods, and so on, to ensure the rights and interests of special bus passengers. The last part is a summary of the whole article.
