【摘要】：自1997年《中華人民共和國拍賣法》頒布實施以來,我國拍賣行業(yè)已步入有序化、法制化和正規(guī)化的發(fā)展軌道。盡管我國針對拍賣業(yè)的立法相對于其他國家而言較為完整,但如今,由于《拍賣法》頒布的時間太過久遠(yuǎn),它對拍賣市場,尤其是藝術(shù)品拍賣市場的規(guī)制早已力所不及,無法遏制當(dāng)前藝術(shù)品拍賣市場中出現(xiàn)的種種不法行為。藝術(shù)品拍賣業(yè)因其拍賣標(biāo)的的高風(fēng)險性而有別于其他商品拍賣。作為拍賣標(biāo)的物的藝術(shù)品,其本身真?zhèn)坞y辨,缺乏統(tǒng)一的定價標(biāo)準(zhǔn),交易時的信息不對稱,加之“聲明不保真”條例的濫用,這些特殊的情況大大地提高了現(xiàn)行法案的執(zhí)行難度。與此同時,作為拍賣市場上的明星產(chǎn)品,藝術(shù)品拍賣交易無疑吸引了大量投資者的目光。作為人們對拍賣市場了解的一個重要窗口,其交易狀況必然成為拍賣市場的風(fēng)向標(biāo)。藝術(shù)品拍賣市場的走勢和發(fā)展的好壞將直接影響投資者對其本身乃至對整個拍賣市場的信任和興趣,也是影響著整個行業(yè)是否能健康穩(wěn)定發(fā)展的重要因素。所以,對于藝術(shù)品拍賣市場的全面整頓已成為當(dāng)務(wù)之急,而其中,對于我國藝術(shù)品拍賣市場的法律規(guī)制問題則是重中之重。然而,目前我國關(guān)于拍賣市場法律規(guī)制的相關(guān)研究雖不在少數(shù),但是專門針對藝術(shù)品拍賣市場法律規(guī)劃的研究卻十分有限。因此,本文將立足現(xiàn)狀,基于前人經(jīng)驗及自我總結(jié),對此問題進(jìn)行研究。本文主要分為五個部分,第一部分是以拍賣的定義及特征和藝術(shù)品拍賣的范疇及組成部分作為藝術(shù)品拍賣的機(jī)理進(jìn)行研究,并梳理了藝術(shù)品拍賣的過程。第二部分主要是對我國藝術(shù)品拍賣市場的發(fā)展和失序的情況進(jìn)行討論。同時通過對我國藝術(shù)品拍賣市場發(fā)展的歷史進(jìn)行梳理,從而歸納出藝術(shù)品拍賣市場失序的幾點主要表現(xiàn)。本文第三部分討論了我國目前藝術(shù)品拍賣市場的立法現(xiàn)狀和立法缺陷的問題。本文第四部分則通過研究西方經(jīng)濟(jì)發(fā)達(dá)國家和地區(qū)對藝術(shù)品拍賣市場的立法與規(guī)制手段來找到我國可以借鑒的相關(guān)理論和實踐經(jīng)驗,包括對拍賣人、鑒定師和免責(zé)條款等發(fā)面的經(jīng)驗借鑒。本文第五部提出了強化市場準(zhǔn)入、強化拍賣中涉假行為的法律追究制度、建立聲明不保真條款的救濟(jì)機(jī)制以及加強行業(yè)自律監(jiān)管這幾點完善我國藝術(shù)品拍賣市場法律規(guī)制的建議。
[Abstract]:Since the promulgation and implementation of the auction Law of the people's Republic of China in 1997, the auction industry in China has entered the track of orderly, legalized and regularized development. Although our country's legislation on auction industry is relatively complete compared with other countries, now, because the auction law has been promulgated for too long, it has long been unable to regulate the auction market, especially the art auction market. Unable to curb the current art auction market in the emergence of various illegal behavior. The art auction industry is different from other commodity auctions because of the high risk of its subject matter. Works of art, which are the subject of auction, are hard to tell whether they are true or false, lack of uniform pricing standards, asymmetric information when they are traded, and the abuse of the "declaration of unfidelity" regulations. These special circumstances have greatly increased the difficulty of implementing the current Act. At the same time, as a star in the auction market, the art auction undoubtedly attracted the attention of a large number of investors. As an important window for people to understand the auction market, its trading situation must become the vane of auction market. The trend and development of the art auction market will directly affect the investors' trust and interest in itself and the whole auction market. It is also an important factor that affects the healthy and stable development of the whole industry. Therefore, the overall rectification of the art auction market has become an urgent task, among which, the legal regulation of the art auction market in China is the most important. However, although there are not a few studies on the legal regulation of the auction market in our country, the research on the legal planning of the art auction market is very limited. Therefore, based on the status quo, based on previous experience and self-summary, this paper will study this problem. This paper is divided into five parts. In the first part, the definition and characteristics of auction, the category and component of art auction as the mechanism of art auction are studied, and the process of art auction is combed. The second part mainly discusses the development and disorder of Chinese art auction market. At the same time, by combing the history of the development of the art auction market in China, this paper summarizes the main manifestations of the disorder in the art auction market. The third part of this paper discusses the current legislation and defects of the art auction market in China. The fourth part of this paper studies the legislation and regulation of art auction market in western developed countries and regions to find the relevant theory and practical experience that our country can use for reference, including to the auctioneers. Appraiser and exemption clause and other facade experience for reference. The fifth part of this paper proposed to strengthen the market access, strengthen the auction related to the fraud of the legal investigation system, It is suggested to establish a relief mechanism for declaring non-fidelity clauses and to strengthen the self-regulation of the industry in order to improve the legal regulation of the art auction market in China.
