【摘要】：反洗錢行政處罰是保證反洗錢監(jiān)管有效性的重要手段,但反洗錢行政處罰幅度如何自由裁量并未有明確的規(guī)范,在實際工作中容易出現(xiàn)自由裁量濫用的情況,一定程度上影響反洗錢監(jiān)管的有效性。結(jié)合反洗錢法律法規(guī)和相關(guān)實踐經(jīng)驗,構(gòu)建了反洗錢行政處罰影響因素體系;在此基礎(chǔ)上,利用專家調(diào)查權(quán)重法建立了反洗錢行政處罰自由裁量技術(shù)模型,確立了模型系數(shù),并對模型的有效性進行了驗證。結(jié)果表明:反洗錢行政處罰自由裁量技術(shù)模型完全符合《反洗錢法》規(guī)定的處罰要求和幅度,可以為反洗錢行政處罰自由裁量權(quán)濫用提供有效解決路徑。
[Abstract]:Anti-money laundering administrative punishment is an important means to ensure the effectiveness of anti-money laundering supervision. However, the extent of administrative punishment for anti-money laundering is not clearly regulated, and it is easy to be abused freely in actual work. To some extent affect the effectiveness of anti-money laundering supervision. Combined with anti-money laundering laws and regulations and relevant practical experience, this paper constructs the influence factor system of anti-money laundering administrative punishment, and on this basis, establishes the discretion technical model of anti-money laundering administrative penalty by using the expert investigation weight method, and establishes the model coefficient. The validity of the model is verified. The results show that the technical model of discretion of administrative punishment of anti-money laundering fully accords with the requirement and scope of punishment stipulated in the Anti-Money-Laundering Law and can provide an effective way to solve the abuse of discretion in administrative punishment of anti-money laundering.
