【摘要】：通過研究296份相關(guān)司法判決可以發(fā)現(xiàn),司法實(shí)務(wù)中出現(xiàn)的保險金請求權(quán)是否能夠轉(zhuǎn)讓、人身保險合同是否適用補(bǔ)償原則等爭議常與人身保險利益內(nèi)涵的認(rèn)識分歧有關(guān)。人身保險利益與財(cái)產(chǎn)保險利益有著較大差異,對人身保險利益內(nèi)涵的認(rèn)識容易受類比適用的思維進(jìn)路束縛。在以社會發(fā)展的視閾認(rèn)識人身保險利益的同時也應(yīng)看到人身保險標(biāo)的與人身保險利益為不同維度的內(nèi)涵。從最初的法律規(guī)定上看,人身保險利益就表現(xiàn)出一種強(qiáng)烈的家庭關(guān)系人身依附的屬性。隨著團(tuán)體保險的興起以及可能存在人身保險利益樣態(tài)的多元化,這種人身依附的屬性得以淡化,但并非消除。人身保險利益本質(zhì)為一種以倫理為基礎(chǔ)的人身依附屬性的利害關(guān)系,同時我國《保險法》第31條第2款的同意應(yīng)理解為基于一定利害關(guān)系的同意。
[Abstract]:Through the study of 296 relevant judicial decisions, we can find that disputes such as whether the claim right of insurance gold can be transferred and whether the principle of compensation is applicable to personal insurance contract are often related to the different understanding of the connotation of personal insurance interests. There are great differences between the interests of personal insurance and that of property insurance, and the understanding of the connotation of interests of personal insurance is easily bound by the thinking of analogy. At the same time, it is necessary to understand the connotation of the subject matter of personal insurance and the interests of personal insurance in the different dimensions while recognizing the interests of personal insurance from the perspective of social development. From the initial legal provisions, the interests of personal insurance show a strong family relationship of personal attachment attribute. With the rise of group insurance and the diversification of life insurance benefits, the attribute of personal attachment can be desalinated, but not eliminated. The essence of life insurance interest is a kind of interest which is based on ethics, and the consent of Article 31 (2) of our country's Insurance Law should be understood as consent based on certain interest.
