【摘要】：招標(biāo)投標(biāo)作為一種具有競爭性的經(jīng)濟(jì)活動,現(xiàn)已成為煙草行業(yè)貨物、工程、服務(wù)采購的主要形式和實(shí)現(xiàn)一般公正的重要手段。隨著招標(biāo)范圍和規(guī)模正在逐步擴(kuò)大,國家煙草專賣局提出"應(yīng)招盡招、真招實(shí)招"的工作要求。招標(biāo)文件的歧視性條款已成為影響煙草行業(yè)"真招實(shí)招"的突出問題之一。早在2000年出臺的《招標(biāo)投標(biāo)法》就明確規(guī)定"招標(biāo)人不得以不合理的條件限制或者排斥潛在投標(biāo)人,不得對潛在投標(biāo)人實(shí)行歧視待遇",但直至2011年頒布的《招標(biāo)投標(biāo)法實(shí)施條例》才以法條形式列舉了歧視性條款的六種具體類型。文章通過案例分析,引出歧視性條款的定義、危害,并進(jìn)一步分析了歧視性條款的五種表現(xiàn)形式,并有針對性地提出了防范對策,以期能為煙草行業(yè)招標(biāo)采購工作健康良性發(fā)展提供一些啟發(fā)和幫助。
[Abstract]:As a competitive economic activity, bidding has become the main form of procurement of goods, engineering and services in tobacco industry and an important means to achieve general justice. With the scope and scale of bidding gradually expanding, the State Tobacco Monopoly Bureau put forward the work request of "recruit all the students, and really recruit the real ones". The discriminatory provisions of bidding documents have become one of the outstanding problems affecting tobacco industry. As early as 2000, the Law on bidding and bidding clearly stipulated that "the tenderer shall not restrict or exclude potential bidders under unreasonable conditions," "No discriminatory treatment may be applied to potential bidders", but it was not until the implementation regulations of the bidding Law promulgated in 2011 that the six specific types of discriminatory provisions were listed in the form of articles. Through the case analysis, the paper draws out the definition and harm of the discriminatory clause, and further analyzes the five manifestations of the discriminatory clause, and puts forward the preventive countermeasures. In order to provide some inspiration and help for the healthy development of bidding and purchasing in tobacco industry.
