【摘要】：BT模式簡稱投融資建設(shè)(Build Transfer)模式,也就是建設(shè)——移交項目建設(shè)模式。這種模式可謂一種新的公私合作項目開發(fā)模式,是Bot融資模式逐步變化而成的新建設(shè)開發(fā)方式。上個世紀八十年代,該模式在一些發(fā)達國家特別流行,如美國,東南亞,澳洲等,伴隨時間推移,我國經(jīng)濟呈現(xiàn)出飛躍式發(fā)展,國民生活愈發(fā)富裕,特別是公共設(shè)施建設(shè)和新城市項目建設(shè)越來越多,BT模式也逐步在我們國家流行開來。然而,因為我們國家使用BT模式的時間尚短,依然處于初步嘗試階段,運用不是特別熟練,而且此模式參與主體沒有明確的責任規(guī)定,范圍涉獵廣,有一系列風險因素等,這都讓BT模式不易操作。另外,當下我國尚無適用于調(diào)整BT模式的專門法律條文,現(xiàn)存配套法律規(guī)定很不健全,實際操作中,依然十分紊亂,這讓BT模式在操作時各個參與主體有可能遇到很多法律風險。所以,怎樣讓BT模式有關(guān)理論更加完善,怎樣對于該模式相關(guān)法律關(guān)系作出準確剖析,深入了解當事人間各種義務(wù)權(quán)利,法律關(guān)系和法律風險,規(guī)避風險的策略等,這對于BT模式實際運用而言,都是十分重要的。本論文內(nèi)容主要包括：闡述BT模式內(nèi)涵,探究參與者間的各種法律關(guān)系,該模式國內(nèi)研究現(xiàn)狀和立法狀況,該模式參與者潛在法律風險和規(guī)避風險的策略與方法等,研究這些內(nèi)容,旨在促進我國BT模式的發(fā)展與運用,為我們國家經(jīng)濟增長提供更多動力!該論文的整體結(jié)構(gòu)為：第一部分是對于BT模式內(nèi)涵的講解,并闡述了其基本理論和該模式產(chǎn)生原因、背景、法律關(guān)系等；本文第二部分則分析了BT模式里各個參與方相互間的各種法律關(guān)系；文章第三部分是對于我們國家當前有關(guān)BT模式的法律規(guī)定以及外國立法狀況進行了探討和論述,最后提出了怎樣構(gòu)建我們國家BT模式相關(guān)法律體制的建議與策略。
[Abstract]:The BT model is referred to as the investment and financing construction build transfer model, that is, the build-transfer project construction model. This model can be described as a new public-private partnership project development model. It is a new mode of construction and development resulting from the gradual change of the Bot financing model. In the 1980s, this model was particularly popular in some developed countries, such as the United States, Southeast Asia, Australia, and so on. With the passage of time, China's economy showed a rapid development. People are getting richer, especially in the construction of public facilities and new urban projects, and the BT model is gradually becoming popular in our country. However, because our country has been using BT model for a short time, it is still in its initial stage of trial. Application is not particularly skilled, and this model participants have no clear liability provisions, a wide range of risk factors and so on, which makes BT model difficult to operate. At present, there are no special legal provisions applicable to the adjustment of BT mode in our country. The existing supporting laws and regulations are not perfect, and in actual operation, they are still very chaotic. Therefore, how to make BT model theory more perfect, how to analyze the relevant legal relationship of BT model accurately, It is very important for the practical application of BT mode to deeply understand the rights of obligations, legal relations and legal risks between the parties, the strategy of avoiding risks, etc. The content of this paper mainly includes: expounding the connotation of BT mode, and so on. In order to promote the development and application of BT model in China, the author probes into various legal relationships among participants, domestic research status and legislation status, potential legal risks and strategies and methods of avoiding risks, etc., and studies these contents in order to promote the development and application of BT model in China. For our country's economic growth to provide more power! The whole structure of this paper is as follows: the first part explains the connotation of BT model, and expounds its basic theory and the reason, background, legal relationship of the model. The second part of this paper analyzes the various legal relations among the participants in the BT model, the third part of the article is to discuss and discuss the current laws and regulations of BT model in our country as well as the status of foreign legislation. Finally, it puts forward some suggestions and strategies on how to construct the relevant legal system of BT model in our country.
