【摘要】：以"微信紅包"為代表的互聯(lián)網(wǎng)社交金融正在成為互聯(lián)網(wǎng)金融的"寶地",但其在發(fā)展中也凸顯出相關(guān)法律問(wèn)題,紅包法律性質(zhì)及涉稅問(wèn)題不明確、可能觸犯刑法邊界、交易安全及消費(fèi)者權(quán)益堪憂(yōu)、準(zhǔn)入及退出機(jī)制欠缺等。因此可以借鑒域外經(jīng)驗(yàn),從企業(yè)提供基金服務(wù)盤(pán)活沉淀資金、各方合力促進(jìn)監(jiān)管、完善市場(chǎng)準(zhǔn)入與退出機(jī)制及充分實(shí)現(xiàn)行業(yè)自律等方面尋找"微信紅包"法律問(wèn)題的解決之道。
[Abstract]:Internet social finance, represented by "WeChat red packet", is becoming a "treasure spot" of Internet finance, but it also highlights relevant legal problems in its development. The legal nature and tax-related issues of red envelopes are unclear, which may violate the boundary of criminal law. Trading safety and consumer rights are worrying, and access and exit mechanisms are lacking. Therefore, we can draw lessons from overseas experience and invigorate precipitation funds from the provision of fund services by enterprises, and all parties can work together to promote supervision. To perfect the mechanism of market access and withdrawal and to fully realize the self-discipline of the industry, to find the solution to the legal problems of WeChat red packet.
