論我國快遞快件賠償制度的完善

【摘要】:近年來我國快遞產(chǎn)業(yè)發(fā)展迅速,為人們的生活帶來了巨大的便利。但由于我國快遞行業(yè)起步晚,相關(guān)制度并不完善,導致我國快遞的申訴量和申訴率都很高,特別是在快遞快件的賠償方面。因此,本文針對快遞快件賠償制度中存在的問題進行分析,以期在今后的有關(guān)快遞的立法中能有所改善,達到既有利于保護快遞消費者的合法權(quán)益,又能促進我國快遞企業(yè)發(fā)展的目標。全文根據(jù)快遞快件賠償制度缺陷的解決為路徑展開論證,共分為四個部分。第一部分的主要內(nèi)容是我國快遞快件賠償制度的立法現(xiàn)狀和制度缺陷。通過對快遞服務(wù)的行業(yè)法規(guī)以及有關(guān)快遞賠償?shù)拿袷路ㄒ?guī)進行分析,從快件賠償格式條款的無效情形、未保價限額賠償?shù)臓幾h、實際價值與保價金額的爭議、快遞快件延誤賠償?shù)穆┒础⒑炇粘绦虿缓侠淼任鍌方面進行梳理,分析其存在的制度缺陷。本文第二部分對我國快遞快件賠償制度進行分析。首先,對快遞快件賠償制度中的基本問題進行闡述,主要論述賠償請求的依據(jù)、請求賠償?shù)闹黧w、賠償?shù)男再|(zhì)與范圍、賠償?shù)臍w責原則以及舉證責任等。其次,討論賠償制度的價值選擇,通過保護消費者與扶持快遞企業(yè)發(fā)展的價值博弈,得出本文論述的重點。本文的第三部分論述了我國快遞快件賠償制度的完善。本部分以第一、二部分的制度分析為基礎(chǔ),進而對我國快遞快件的賠償制度的完善提出建議。首先,從法律體系上進行完善,將現(xiàn)有快遞快件賠償?shù)姆煞ㄒ?guī)進行整合。其次,從立法內(nèi)容上進行完善。結(jié)論部分論述了本文研究的意義。快遞快件的賠償制度是一個既關(guān)系到消費者權(quán)益保護又關(guān)系到快遞企業(yè)發(fā)展的問題,過度傾向消費者權(quán)益的保護則會使企業(yè)背負上過重的賠償負擔不利于企業(yè)的發(fā)展;過度的扶持企業(yè)發(fā)展,又會使消費者的索賠難度上升不利于消費者權(quán)益的保護。因此,完善我國快遞快件賠償制度對于理論和實踐兩方面來說都有著重要的意義。
[Abstract]:The rapid development of express industry in China in recent years has brought great convenience to people's life. However, due to the late start of express delivery industry in China, the related system is not perfect, which leads to the high appeal volume and appeal rate of express delivery in our country. Especially in the aspect of the compensation of express delivery. Therefore, this paper analyzes the problems existing in the system of express courier compensation, with a view to improving the legislation on express delivery in the future. To achieve the goal of protecting the legitimate rights and interests of express delivery consumers and promoting the development of express delivery enterprises in China. It is divided into four parts. The main content of the first part is the current legislative situation and system defects of the express delivery compensation system in China. Through the analysis of the industry regulations of express delivery service and the civil law of express delivery compensation, It is combed from five aspects, such as the invalidation of the terms of the express payment format, the dispute over the uninsured price limit, the dispute between the actual value and the insured amount, the loophole in the delay compensation of express delivery, the unreasonable signing procedure, etc. The second part of this paper analyzes the compensation system of express courier in China. Firstly, it expounds the basic problems of the system, mainly discusses the basis of the claim, the main body of the claim. The nature and scope of compensation, the liability principle of compensation and the burden of proof etc. Secondly, the value selection of compensation system is discussed, and the value game between protecting consumers and supporting the development of express delivery enterprises is discussed. The third part of this paper discusses the perfection of China's express courier compensation system. This part is based on the system analysis of the first and second parts. And then put forward some suggestions on how to perfect the compensation system of express courier in our country. First, we should perfect the legal system, and integrate the existing laws and regulations of the compensation of express courier. Secondly, The conclusion part discusses the significance of this study. The compensation system of express express delivery is a problem related to the protection of consumers' rights and interests as well as the development of express delivery enterprises. Excessive propensity to protect the rights and interests of consumers will make enterprises bear an excessive burden of compensation against the development of enterprises; excessive support for the development of enterprises will also make it more difficult for consumers to claim compensation, which will not be conducive to the protection of consumers' rights and interests. It is of great significance for both theory and practice to perfect the compensation system of express delivery in China.
