【摘要】：政策性金融機構(gòu)在我國產(chǎn)生并運營已達21年之久,但從其運營的法律保障及監(jiān)督依據(jù)來看,到目前為止專門的政策性金融法律仍然缺位,亟須適應(yīng)各政策性金融機構(gòu)加快改革發(fā)展。在立法的過程中首先需要明確的一個基礎(chǔ)性前提性問題是,對政策性金融機構(gòu)的法律地位做出適合其自身特性的科學界定,這關(guān)系到出臺的法律的方向性及其對政策性金融機構(gòu)的規(guī)范約束的適應(yīng)性問題。而要明確政策性金融機構(gòu)的法律地位須以認清其本質(zhì)特征為基礎(chǔ)。通過綜合分析所有相關(guān)因素之后認為,政策性金融機構(gòu)從法律地位上來講是一種具有特殊性的公法法人。
[Abstract]:Policy-oriented financial institutions have been operating in China for 21 years, but from the legal guarantee and supervision basis of their operation, up to now, the special policy-oriented financial law is still absent. It is urgent to adapt to the reform and development of various policy-oriented financial institutions. In the process of legislation, it is necessary to make a scientific definition of the legal status of policy-oriented financial institutions in accordance with their own characteristics. This is related to the orientation of the law and its adaptability to the normative constraints of policy-oriented financial institutions. The legal status of policy-oriented financial institutions should be determined on the basis of a clear understanding of their essential characteristics, and through comprehensive analysis, it is necessary to make sure that the legal status of policy-oriented financial institutions is based on a comprehensive analysis. After all the relevant factors are considered, The policy-oriented financial institution is a kind of special legal person in public law in terms of its legal status.
