【摘要】：政府購買公共服務(wù)是二十世紀七八十年代政府改革浪潮的興起以來,政府在逐步由“大包大攬”全能政府向“小政府”轉(zhuǎn)變的過程中一種新興的政府管理手段。作為一種具有官民協(xié)商、合作治理特性的理性程序,它反映了在公共治理的過程中政府更加注重引入私人力量,如通過合同外包、政府購買、民營化等形式來發(fā)揮私人在公共治理過程中的作用。政府購買、合同外包等形式的私人力量的注入在行政法的理論及實務(wù)界引起了了不小的爭議及法律問題,如政府購買公共服務(wù)的興起原因、私人介入的范圍,政府責(zé)任的流失等問題。 本文主要分為五個部分。第一部分主要是政府購買公共服務(wù)的概述,主要介紹政府購買公共服務(wù)的內(nèi)涵、動機及原則,全面認識政府購買公共服務(wù)。第二、三部分是主要介紹我國及其他發(fā)達國家政府購買公共服務(wù)的現(xiàn)狀和購買經(jīng)驗,對其存在的法律問題進行整合,以便于在后面逐條分析,歸納對策。第四部分通過對不同主體在政府購買公共服務(wù)這一法律關(guān)系中的權(quán)利義務(wù)進行再次的分解分析,明確各方主體責(zé)任。第五部分主要是在前文基礎(chǔ)上結(jié)合我國的立法及購買實踐對我國政府購買公共服務(wù)的合理建議。 筆者在本文的寫作過程深受美國學(xué)者朱迪·弗里曼教授的《合作治理與新行政法》一書中新行政法思想的啟發(fā),企圖通過我國政府主體角色的積極轉(zhuǎn)變以引進多方混合主體,以多元化的責(zé)任承擔(dān)主體和監(jiān)督評價機制來降低購買風(fēng)險。當(dāng)然,這些都離不開立法機關(guān)的積極配合,通過有效的立法為政府購買機制的健全和完善提供強有力的法律支撐。
[Abstract]:The purchase of public services by the government is since the rise of the wave of government reform in the 1970s and 1980s in 20th century. The government is gradually changing from "all-around" government to "small government". As a rational procedure with the characteristics of consultation between the government and the people, the government has the characteristics of cooperative governance. It reflects that in the process of public governance, the government pays more attention to the introduction of private power, such as through contract outsourcing, government purchase, privatization and other forms to play the role of private in the process of public governance. The injection of private power, such as contract outsourcing, has caused many disputes and legal problems in the theory and practice of administrative law, such as the rise of government purchase of public services, the scope of private intervention, the loss of government responsibility, and so on. This paper is divided into five parts. The first part is an overview of government purchase of public services, mainly introduces the connotation, motivation and principles of government purchase of public services, comprehensive understanding of government purchase of public services. The third part mainly introduces the current situation and experience of government purchase of public services in China and other developed countries, and integrates the existing legal problems in order to analyze them one by one in the future. Part 4th analyzes again the rights and obligations of different subjects in the legal relationship of government purchase of public services. The 5th part is mainly about the reasonable suggestion to our government to purchase public service on the basis of the legislation and purchase practice of our country. The author is deeply inspired by the idea of new administrative law in the book Cooperative Governance and New Administrative Law by Professor Judy Freeman, an American scholar, and attempts to introduce mixed subjects through the positive transformation of the main role of the government in our country. Of course, all of these can not be separated from the active cooperation of the legislature and provide strong legal support for the perfection and perfection of the government purchase mechanism through effective legislation.
