【摘要】：通過(guò)具體考察發(fā)現(xiàn),農(nóng)村市場(chǎng)上多元化格局的互聯(lián)網(wǎng)金融是市場(chǎng)主體的自然選擇,具有非抑制性和市場(chǎng)自發(fā)性的特點(diǎn),以此構(gòu)成了與傳統(tǒng)農(nóng)村金融的天然區(qū)別,這決定了其制度變遷模式應(yīng)該是誘致性制度變遷模式。法學(xué)和經(jīng)濟(jì)學(xué)的相關(guān)理論都認(rèn)為法律制度具有激勵(lì)功能,金融制度就是一個(gè)典型。而農(nóng)村市場(chǎng)的互聯(lián)網(wǎng)金融的發(fā)展面臨著模式合法性風(fēng)險(xiǎn)、服務(wù)能力有限、可持續(xù)能力不樂(lè)觀、安全性風(fēng)險(xiǎn)等多種瓶頸制約,這需要發(fā)揮金融制度的激勵(lì)功能�？刹捎谜�(lì)和負(fù)激勵(lì)兩個(gè)維度來(lái)構(gòu)建一個(gè)基本制度框架,具體表現(xiàn)為最大限度尊重市場(chǎng)選擇、盡可能降低交易成本和差別化監(jiān)管金融風(fēng)險(xiǎn)。
[Abstract]:Through specific investigation, it is found that Internet finance with diversified pattern in the rural market is the natural selection of the main body of the market, and has the characteristics of non-inhibition and market spontaneity, which constitutes the natural difference between the Internet finance and the traditional rural finance. This determines that the model of institutional change should be induced institutional vicissitude. The relevant theories of law and economics both think that the legal system has the function of motivation. The financial system is a typical one. The development of Internet finance in the rural market is faced with the risks of model legitimacy, limited service capacity, low sustainability, security risks, and so on. Two dimensions of positive incentive and negative incentive can be adopted to construct a basic institutional framework, which can be manifested as follows: respecting market choice to the maximum extent, reducing transaction cost and differential financial risk.
