【摘要】：正我國的金融法律制度經(jīng)過多年的發(fā)展,形成了以《中國人民銀行法》《商業(yè)銀行法》《銀行業(yè)監(jiān)督管理法》《證券法》《證券投資基金法》《保險法》等基礎金融法律為核心、以行政法規(guī)和規(guī)章規(guī)范性文件為重要內(nèi)容的制度框架。現(xiàn)行金融法律制度結構基本合理、體系較為完備,為維護國家金融秩序、保障金融業(yè)穩(wěn)健運行、支持經(jīng)濟持續(xù)發(fā)展發(fā)揮了重要作用。但也要看到,隨著近年來我國金融業(yè)的發(fā)展和金融改革的深化,部分金融法律法規(guī)已經(jīng)難以適應當前金融業(yè)快速發(fā)展和金融創(chuàng)新不斷加快的形勢,也存在不少立法空白亟待填補。因此,有必要繼續(xù)加強金融法制建設,使之成為金融業(yè)改革與發(fā)展的可靠保障。
[Abstract]:After years of development, China's financial legal system has formed basic financial laws, such as the people's Bank of China Law, the Commercial Bank Law, the Banking Supervision and Administration Law, the Securities Law, the Securities Investment Fund Law, the Insurance Law, and other basic financial laws. The current financial legal system is basically reasonable and has a relatively complete system. In order to maintain the national financial order and ensure the steady operation of the financial industry, Support for sustained economic development has played an important role. However, it should also be noted that with the development of our financial sector and the deepening of financial reform in recent years, Some financial laws and regulations have been unable to adapt to the current situation of the rapid development of the financial industry and the constant acceleration of financial innovation, and there are many legislative gaps that need to be filled. Therefore, it is necessary to continue to strengthen the construction of the financial legal system. To make it a reliable guarantee for the reform and development of the financial industry.
