【摘要】：必需設(shè)施原理發(fā)端于美國(guó)終端鐵路協(xié)會(huì)案,并在傳統(tǒng)行業(yè)有著豐富的適用實(shí)踐。但在新興的互聯(lián)網(wǎng)行業(yè),互聯(lián)網(wǎng)的特性制約著必需設(shè)施原理的運(yùn)用,在必需設(shè)施原理適用于互聯(lián)網(wǎng)領(lǐng)域的個(gè)案中,也存在明顯的分歧。無(wú)論是必需設(shè)施原理的爭(zhēng)論、典型案例的裁判結(jié)果,還是必需設(shè)施的形成方式、互聯(lián)網(wǎng)發(fā)展的階段,都要求我國(guó)確立謹(jǐn)慎適用必需設(shè)施原理的基本思路。
[Abstract]:The principle of necessary facilities originated in the case of the American Terminal Railway Association and has a rich application in the traditional industry, but in the emerging Internet industry, the characteristics of the Internet restrict the application of the principle of necessary facilities. In the case where the principle of necessary facilities is applicable to the Internet, there are also obvious differences. Whether it is the argument of the principle of the necessary facility, the result of the typical case, or the formation of the necessary facility. The stage of Internet development requires our country to establish the basic train of thought of applying the principle of necessary facilities carefully.
