【摘要】：行政許可設(shè)定是對共享經(jīng)濟(jì)實(shí)施法律規(guī)制的重要方式,應(yīng)當(dāng)確保行政許可設(shè)定本身的合法性。行政許可設(shè)定的合法性審查思路分兩步驟:第一步是判斷受審查的行政許可設(shè)定行為的法律屬性;第二步是從行政許可實(shí)施主體、條件、程序與期限四個方面繼續(xù)判斷其合法性。依據(jù)這一合法性審查思路,《上海網(wǎng)約車新規(guī)》中三個網(wǎng)約車行政許可設(shè)定的法律屬性存在含糊之處,且無論如何定性都與上位法存在矛盾之處。并且目前與三個網(wǎng)約車行政許可相關(guān)的國務(wù)院決定、部門規(guī)章與地方性法規(guī)的規(guī)定存在合法性問題,同時也存在相互沖突與矛盾之處,需要通過立法調(diào)整來進(jìn)行彌補(bǔ)。
[Abstract]:The establishment of administrative license is an important way to regulate the sharing economy. It is necessary to ensure the legitimacy of administrative license creation itself. The idea of legitimacy examination of administrative license creation is divided into two steps: the first step is to judge the legal attribute of administrative license creation behavior under review; The second step is to continue to judge the legality of the administrative license from four aspects: the subject, the condition, the procedure and the time limit. There are some ambiguities in the three legal attributes of the administrative license for ride-sharing in Shanghai. And in any case qualitative and epistatic law there are contradictions. And at present with the three net ride-sharing administrative license related to the State Council decisions departmental regulations and local laws and regulations there are legal issues. At the same time, there are also conflicts and contradictions, which need to be compensated through legislative adjustment.
