我國(guó)保險(xiǎn)中介機(jī)構(gòu)監(jiān)管問(wèn)題研究

【摘要】:保險(xiǎn)行業(yè)隨著社會(huì)化生產(chǎn)的日漸繁榮逐漸出現(xiàn)了精細(xì)分工的趨勢(shì),我國(guó)保險(xiǎn)市場(chǎng)主要分為保險(xiǎn)人、投保人和保險(xiǎn)中介這三類(lèi)主體,這三類(lèi)主體中保險(xiǎn)中介占據(jù)了很重要的地位,中介機(jī)構(gòu)的出現(xiàn)推動(dòng)了保險(xiǎn)市場(chǎng)發(fā)展,也起著獨(dú)特的作用。雖然它誕生的時(shí)間短,但已經(jīng)潛移默化的深入到現(xiàn)在的社會(huì)生活中,逐漸被人們認(rèn)識(shí)并接受。保險(xiǎn)中介機(jī)構(gòu)可以分為保險(xiǎn)經(jīng)紀(jì)人、保險(xiǎn)代理人和保險(xiǎn)公估人,三者之間存在著聯(lián)系,又因?yàn)槠湓诒kU(xiǎn)市場(chǎng)中的不同作用相互獨(dú)立。逐漸形成了有機(jī)的運(yùn)營(yíng)機(jī)制,成為保險(xiǎn)中介市場(chǎng)重要的組成元素。同時(shí)可知,保險(xiǎn)中介機(jī)構(gòu)和保險(xiǎn)公司的業(yè)務(wù)往來(lái)反映保險(xiǎn)市場(chǎng)的專(zhuān)業(yè)技能水平和集約化經(jīng)營(yíng)程度。直到二十世紀(jì)末,我國(guó)的保險(xiǎn)中介行業(yè)才開(kāi)始發(fā)展起來(lái),到現(xiàn)在為止只經(jīng)歷了二十幾年的時(shí)間,雖然保險(xiǎn)中介行業(yè)在立法上取得了一定的成果,但是無(wú)論是實(shí)踐研究還是理論研究都不能滿(mǎn)足現(xiàn)在保險(xiǎn)市場(chǎng)發(fā)展的需求,為了保障保險(xiǎn)供求雙方平衡且獨(dú)立的關(guān)系,一套完備的保險(xiǎn)中介監(jiān)管制度就成為日漸重要的后備力量,尤其在法律層面上的制約尤為重要。我們可以發(fā)現(xiàn)現(xiàn)有的法律制度起著關(guān)鍵作用。特別是在新頒布的《保險(xiǎn)法》里,法律規(guī)制更顯成熟,多層面上對(duì)保險(xiǎn)中介做出詳細(xì)的規(guī)定。但是仍有很多需要進(jìn)步的空間,比如法律的滯后使現(xiàn)有的法律法規(guī)無(wú)法滿(mǎn)足日益發(fā)展的保險(xiǎn)中介市場(chǎng)的需求,這就導(dǎo)致了保險(xiǎn)市場(chǎng)環(huán)境下出現(xiàn)更多的困境。筆者將借鑒國(guó)際成熟的保險(xiǎn)中介市場(chǎng),結(jié)合當(dāng)下我國(guó)特有的保險(xiǎn)中介機(jī)構(gòu)狀況和問(wèn)題淺析如何走出法律監(jiān)管制度的困境。國(guó)際環(huán)境日漸成熟穩(wěn)定,外資積極參與我國(guó)的保險(xiǎn)市場(chǎng)促使我們盡快建立與之匹配的保險(xiǎn)中介機(jī)構(gòu)監(jiān)管制度,在這種狀況下要抓住機(jī)遇,迎接挑戰(zhàn),為我國(guó)保險(xiǎn)行業(yè)的專(zhuān)業(yè)化、現(xiàn)代化、國(guó)際化道路掃除障礙。同時(shí),細(xì)化相關(guān)法律法規(guī),拓寬監(jiān)管領(lǐng)域,引入國(guó)際司法實(shí)踐優(yōu)質(zhì)的部分,結(jié)合我國(guó)中介行業(yè)存在的問(wèn)題和困境,為法律監(jiān)管對(duì)策提出更加合理及科學(xué)的依據(jù)。
[Abstract]:With the increasing prosperity of socialized production, the insurance industry has gradually appeared the trend of fine division of labor. The insurance market in China is mainly divided into three categories: insurer, policy holder and insurance intermediary. Insurance intermediary occupies a very important position in these three kinds of subjects. The emergence of intermediary institutions has promoted the development of insurance market and played a unique role, although it was born for a short time. However, the insurance intermediary can be divided into insurance broker, insurance agent and insurance assessor, which is connected with each other. And because of its different roles in the insurance market independent of each other, gradually formed an organic operation mechanism, become an important element of the insurance intermediary market. At the same time, we can know. The business transactions between insurance agencies and insurance companies reflect the level of professional skills and intensive management of the insurance market. Until the end of 20th century, the insurance intermediary industry in China began to develop. So far it has only experienced more than 20 years, although the insurance intermediary industry has achieved certain results in legislation, but neither practical nor theoretical research can meet the needs of the current development of the insurance market. In order to ensure a balanced and independent relationship between supply and demand, a complete insurance intermediary regulatory system has become an increasingly important reserve force. Especially in the legal level constraints are particularly important. We can find that the existing legal system plays a key role. Especially in the newly promulgated "Insurance Law", the legal regulation is more mature. There is still a lot of room for improvement, such as the lag of the law makes the existing laws and regulations can not meet the needs of the growing insurance intermediary market. This has led to more difficulties in the insurance market environment. The author will learn from the international mature insurance intermediary market. Combined with the unique status and problems of insurance intermediary organizations in China, this paper analyzes how to get out of the dilemma of the legal supervision system. The international environment is becoming more and more mature and stable. The active participation of foreign capital in the insurance market of our country urges us to establish the insurance intermediary institution supervision system matching with it as soon as possible. Under this condition, we should seize the opportunity, meet the challenge, and be specialized and modernized for the insurance industry of our country. At the same time, we should refine the relevant laws and regulations, broaden the regulatory field, introduce the high-quality part of international judicial practice, and combine the problems and difficulties of the intermediary industry in our country. It provides a more reasonable and scientific basis for legal supervision.
