【摘要】：互聯(lián)網金融是互聯(lián)網與金融深度結合后的金融創(chuàng)新,是互聯(lián)網時代下的金融變革,其乃互聯(lián)網技術進步與金融壓抑共同促發(fā)而成,是金融改革之勢所趨,但其亦具有引發(fā)風險、侵損投資者利益的潛在危險,故應對之進行法律監(jiān)管,然互聯(lián)網金融的法律監(jiān)管卻面臨"或任其野蠻生長,或遏阻其發(fā)展"的兩難境地。究其癥結,乃是基于傳統(tǒng)法律監(jiān)管路徑所形成消極管制思維所致。如此,政府應跳出傳統(tǒng)法律監(jiān)管思維窠臼,以互聯(lián)網思維重新發(fā)現(xiàn)互聯(lián)網金融法律監(jiān)管之道,即在互動監(jiān)管模式下,通過互聯(lián)網金融于其自治空間內的不斷試錯,政府基于互聯(lián)網金融市場邏輯的監(jiān)管經驗揚棄,以及二者介以互動橋梁的持續(xù)互動,找尋互聯(lián)網金融發(fā)展與法律監(jiān)管目標的平衡之道,從而使互聯(lián)網金融法律監(jiān)管困局得以最終紓解。
[Abstract]:Internet banking financial innovation is the combination of the Internet and financial depth, is the Internet era of financial reform, which is the Internet technology progress and promote common financial repression and financial reform is the trend, but it is also the risk of potentially dangerous damage the interests of investors, thus it is necessary to conduct legal supervision however, the legal supervision of Internet banking is facing "or any of its barbaric growth dilemma, or prevent its development. The crux of the problem, but the traditional legal regulation path based on the formation of negative control thinking. So, the government should jump out of the traditional thinking pattern of legal supervision, the Internet thinking to find Internet banking supervision law that is, in the interactive supervision mode, through trial and error on the Internet financial autonomy space, government supervision experience of discarding the Internet financial market based on logic, as well as the two With the continuous interaction of interactive bridges, we seek for a balance between Internet financial development and legal supervision objectives, so that the difficulties of Internet financial legal supervision can be finally relieved.
