【摘要】：我國為了保障建筑業(yè)有序高效競爭,保證建筑工程質(zhì)量安全而對建筑行業(yè)實行市場準入制度。隨著社會經(jīng)濟體制的轉(zhuǎn)型和改革的不斷深化,建筑業(yè)市場中嚴格的市場準入制度引發(fā)資質(zhì)的借用、掛靠,越級承包、非法分包和違法轉(zhuǎn)包等違法違規(guī)行為,不僅嚴重擾亂了建筑市場的有序競爭,還帶來社會性風(fēng)險。以十八屆三中全會決定對經(jīng)濟改革的要求及深化行政審批制度為背景,建筑業(yè)市場作為市場經(jīng)濟的重要組成部分,研究建筑業(yè)市場是否真的需要市場準入,市場準入的手段和制度體系的改革建議具有深遠的意義。本文從以下三個部分展開論述：第一章為建筑業(yè)市場準入制度的理論基礎(chǔ)及其現(xiàn)狀分析。理論層面,從政府規(guī)制理論分析建筑業(yè)市場準入公共利益和私益理論基礎(chǔ)。討論市場準入與行政許可的關(guān)系。實踐層面,通過觀察分析得出我國建筑業(yè)實行企業(yè)資質(zhì)管理和個人執(zhí)業(yè)資格管理的雙軌制市場準入制度存在嚴重缺陷,建筑業(yè)市場準入行政許可規(guī)制手段失靈的結(jié)論。第二章為建筑業(yè)市場準入規(guī)制改革的基本理念。建筑業(yè)市場準入規(guī)制需要改革完善。改革的基本理念主要在于：以放松準入限制,加強后續(xù)監(jiān)管的規(guī)制緩和與再規(guī)制并存；通過明確行政許可設(shè)定的真正需要范圍標準,完善權(quán)利救濟制度來制約市場準入權(quán)力；重視社會中介組織和民眾等社會公眾力量,加強政府與社會的合作治理。第三章為我國建筑業(yè)市場準入法律規(guī)制完善的對策。在改革理念指導(dǎo)下提出具體的制度設(shè)計改進對策。首先要完善建筑業(yè)市場準入的法律依據(jù),提供專門的、系統(tǒng)的和權(quán)威的法律支撐。其次要完善建筑業(yè)市場主體資質(zhì)監(jiān)管機制,監(jiān)管主體方面加強公私合作；監(jiān)管內(nèi)容方面實行以“以注冊為首,資質(zhì)評級為輔”的企業(yè)準入制度和以“嚴格許可,強化責(zé)任”的從業(yè)人員準入制度；監(jiān)管方式方面要實施全程動態(tài)監(jiān)管,并結(jié)合剛性和柔性的監(jiān)管手段；監(jiān)管責(zé)任方面以監(jiān)管主體類型、權(quán)力來源和監(jiān)管手段綜合判斷。再者要完善建筑業(yè)信用體系、行業(yè)協(xié)會自律管理制度和社會信用中介服務(wù)等配套制度。
[Abstract]:In order to ensure the orderly and efficient competition of the construction industry and ensure the quality and safety of the construction engineering, our country implements the market access system for the construction industry. With the transformation of the social and economic system and the deepening of the reform. The strict market access system in the construction market leads to the borrowing of qualifications, linking, leapfrogging contracting, illegal subcontracting and illegal subcontracting, which not only seriously disturbs the orderly competition in the construction market. The third Plenary session of the 18 CPC Central Committee decided on the requirements of economic reform and deepening the administrative examination and approval system as the background, the construction market as an important part of the market economy. To study whether the construction market really needs market access. The reform of the means and system of market access is of far-reaching significance. This paper discusses the following three parts: the first chapter is the theoretical basis of the construction market access system and its current situation analysis. This paper analyzes the theoretical basis of public interests and private interests of market access in construction industry from the theory of government regulation, and discusses the relationship between market access and administrative licensing. Through observation and analysis, it is concluded that there are serious defects in the dual-track market access system of enterprise qualification management and individual practice qualification management in China's construction industry. The second chapter is the basic idea of the reform of construction market access regulation. The construction market access regulation needs to be reformed and perfected. The basic idea of the reform mainly lies in:. To relax access restrictions. To strengthen the regulation of subsequent supervision and re-regulation co-exist; By clarifying the standard of the real need scope of the administrative license and perfecting the relief system of the right to restrict the power of market access; Attach importance to social intermediary organizations and the public and other social forces. Strengthen the cooperative governance between government and society. Chapter three is the countermeasures to perfect the legal regulation of market access of construction industry in our country. Under the guidance of the reform idea, the author puts forward the concrete countermeasures of system design and improvement. First of all, it is necessary to perfect the market access of construction industry. The legal basis. To provide specialized, systematic and authoritative legal support. Secondly, we should perfect the supervision mechanism of the construction market subject qualification, and strengthen the public-private cooperation in the supervision body; In the aspect of supervision and control, we should implement the entry system of enterprises with "registration first and qualification rating as auxiliary" and the entry system of employees with "strict permission and enhanced responsibility"; In the aspect of supervision mode, the whole process of dynamic supervision should be carried out, and the rigid and flexible means of supervision should be combined; In the aspect of supervision responsibility, it is necessary to comprehensively judge the type of supervision subject, the source of power and the means of supervision. Furthermore, we should perfect the credit system of construction industry, the self-discipline management system of trade association and the intermediary service of social credit.
