【摘要】：《最高人民法院關(guān)于適用〈中華人民共和國(guó)婚姻法〉若干問(wèn)題的解釋（三）》（以下簡(jiǎn)稱解釋（三））的出臺(tái)引起了社會(huì)各界的強(qiáng)烈反響，其表面原因在于離婚后房產(chǎn)的分配問(wèn)題，但更深層次的原因在于我國(guó)法律體系在離婚救助等方面的法律法規(guī)不健全。 本文對(duì)我國(guó)現(xiàn)有的離婚救助制度進(jìn)行歸納，明確各個(gè)條款的適用依據(jù)、救助人群、救助方式等，分析當(dāng)前我國(guó)制度中的不足并挖掘其中的深層原因；通過(guò)對(duì)美國(guó)（特別是加利福尼亞州）離婚扶養(yǎng)制度及相關(guān)案例的學(xué)習(xí)，了解美國(guó)離婚扶養(yǎng)制度的判決、變更和終止等具體實(shí)施情況，分析其所具有的優(yōu)勢(shì)及其在執(zhí)行過(guò)程中所產(chǎn)生的問(wèn)題。通過(guò)對(duì)中美兩國(guó)離婚救助（扶養(yǎng)）制度進(jìn)行辨析為中國(guó)離婚救助制度尋求進(jìn)一步改善的可能性，進(jìn)一步完善中國(guó)離婚救助制度中關(guān)于申請(qǐng)人、申請(qǐng)條件、補(bǔ)償方式、補(bǔ)償額度等各個(gè)方面的法律法規(guī)，從而探尋法律“公平、公正”的本源，以便更好地維護(hù)弱勢(shì)群體的權(quán)益。
[Abstract]:The introduction of the Supreme people's Court's interpretation of certain issues concerning the Application of the Marriage Law of the people's Republic of China (hereinafter referred to as interpretation (3) has caused strong reactions from all walks of life. The apparent reason lies in the distribution of real estate after divorce, but the deeper reason lies in the imperfect laws and regulations in the legal system of our country, such as divorce assistance and so on. This paper summarizes the existing divorce relief system in our country, defines the applicable basis of each clause, the rescue crowd, the rescue method, and so on, analyzes the deficiency in the current system of our country and excavates the deep-seated reason among them. Through the study of the divorce support system in the United States (especially California) and related cases, to understand the specific implementation of the United States divorce support system, such as adjudication, change and termination, Analyze its advantages and problems in the process of implementation. Through the analysis of the divorce assistance (support) system between China and the United States, the possibility of further improvement of the divorce assistance system in China is sought, and the applicant, application conditions and compensation methods in the Chinese divorce assistance system are further perfected. Compensation amount and other laws and regulations, so as to explore the origin of the law "fairness, justice", in order to better protect the rights and interests of vulnerable groups.
