【摘要】：《婚姻法司法解釋三》重點規(guī)定了財產(chǎn)制度,這些規(guī)定是否合理引發(fā)廣泛的爭論。而理性地從法理、社會學(xué)、倫理學(xué)等角度來說,"司解三"規(guī)定婚內(nèi)財產(chǎn)特殊情況下的分割制度具有一定合理性、合法性,而將自然增值劃歸個人財產(chǎn)雖然合理,但將孳息劃歸個人財產(chǎn)則欠缺合理性。"司解三"父母出資房劃歸個人也是合理的,對婚前按揭房歸于個人而給另一方補償?shù)闹贫仍O(shè)計也具有一定合理性,但對夫妻之間財產(chǎn)流轉(zhuǎn)征稅則在當前中國社會來說不具有合理性。
[Abstract]:The judicial interpretation of the Marriage Law III focuses on the property system, and whether these provisions are reasonable or not has caused wide debate. From the angles of legal theory, sociology, ethics and so on, the division system of marital property under special circumstances has some rationality and legitimacy, while it is reasonable to assign natural increment to personal property. However, the division of fruits into personal property is not reasonable. " "it is also reasonable for parents to contribute money to individuals, and it is also reasonable to design the system of compensation to the other party by attributing the premarital mortgage room to the individual," he said. However, the taxation of property circulation between husband and wife is not reasonable in Chinese society.
