【摘要】：以“維護(hù)和保障未成年子女利益”為價(jià)值追求,我國(guó)現(xiàn)行婚姻法確立了探視權(quán)制度。受立法環(huán)境和立法技術(shù)的影響,我國(guó)現(xiàn)行探視權(quán)制度尚存在許多不完善之處,使法的價(jià)值的發(fā)揮受到桎梏。本文擬就我國(guó)探視權(quán)立法存在的缺憾進(jìn)行探討,并提出相關(guān)完善建議。除引言外,本文從四個(gè)方面對(duì)探視權(quán)制度進(jìn)行探討:第一方面是探視權(quán)制度的概述。在本部分,主要探討探視權(quán)界定,分析探視權(quán)的概念、性質(zhì)和法律特征,明確探視權(quán)制度的法律價(jià)值。第二方面是分析不同法域探視權(quán)制度的立法例。分別從大陸法系和英美法系的立法例出發(fā),歸納兩大法系探視權(quán)制度的立法上的不同側(cè)重和特征,分析值得借鑒的立法精神。第三方面是我國(guó)探視權(quán)制度現(xiàn)狀分析。先從現(xiàn)行法律的角度,指出我國(guó)現(xiàn)行法律對(duì)探視權(quán)的規(guī)定存在著明顯的不足。另從,保護(hù)兒童最大利益的角度分析探視權(quán)立法存在的缺陷。第四方面是對(duì)離婚案件中探視權(quán)處理審判難點(diǎn)的立法建議。重點(diǎn)針對(duì)四個(gè)方面的難點(diǎn)。一是擴(kuò)大探視權(quán)的請(qǐng)求權(quán)主體,通過(guò)立法確立探視權(quán)的本意,擴(kuò)大的探視權(quán)主體行使權(quán)利的條件;二是進(jìn)一步明確規(guī)定探視權(quán)的權(quán)利內(nèi)容;三是完善探視權(quán)中止制度。四是構(gòu)建探視權(quán)執(zhí)行制度,要明確探視權(quán)執(zhí)行中應(yīng)堅(jiān)持的幾項(xiàng)原則,按照不同情況制定探視權(quán)執(zhí)行的對(duì)策。結(jié)論部分,筆者總結(jié)了全文,并對(duì)我國(guó)探視權(quán)制度的完善提出了較為合理建議。
[Abstract]:In pursuit of "safeguarding and protecting the interests of minor children", the current Marriage Law of our country establishes the system of visitation right. Under the influence of legislative environment and legislative technology, there are still many imperfections in the present visitation right system of our country, which makes the value of law play a shackle. This paper discusses the shortcomings of visitation right legislation in China, and puts forward some suggestions. In addition to the introduction, this paper discusses the visitation right system from four aspects: the first is an overview of visitation right system. In this part, it mainly discusses the definition of visitation right, analyzes the concept, nature and legal characteristics of visitation right, and clarifies the legal value of visitation right system. The second aspect is to analyze the legislation of visitation right system in different jurisdictions. Starting from the legislation examples of the civil law system and the common law system, this paper summarizes the different emphasis and characteristics of the visiting right system in the two legal systems, and analyzes the legislative spirit that is worth learning from. The third aspect is our country visitation right system present situation analysis. From the point of view of the current law, this paper points out that there are obvious deficiencies in the provisions of visitation right in the current law of our country. In addition, from the point of view of protecting the best interests of children, the defects of visiting right legislation are analyzed. The fourth aspect is to the divorce case visitation right to deal with the trial difficult legislative suggestion. Focus on the difficulties in four aspects. The first is to expand the subject of claim of visitation right, through legislation to establish the original intention of visitation right, the expanded visitation rights subject exercise conditions; two is to further specify the content of visitation rights; third, to improve the system of suspension of visitation rights. The fourth is to construct the execution system of visitation right, to make clear several principles which should be adhered to in the execution of visitation right, and to formulate the countermeasures for the execution of visitation right according to different circumstances. In the conclusion part, the author summarizes the full text and puts forward some reasonable suggestions for the perfection of visitation right system in our country.
