【摘要】：特留份制度源于羅馬法,歷經(jīng)時代變遷,其技術(shù)和應(yīng)用日趨成熟,世界上大多數(shù)國家都以立法形式將其確定下來。其在限制遺囑人遺囑自由、保護特定法定繼承人權(quán)益、維護家庭倫理和社會和諧上起到了重要作用。但我國遺產(chǎn)繼承中并沒有確立特留份制度,用以限制遺囑自由的必留份對遺囑自由的限制較寬松,近親屬繼承人的繼承權(quán)益保護不足,具體條文規(guī)定粗略簡單、可操作性差,已經(jīng)不能完全適應(yīng)現(xiàn)代社會。通過對兩大法系主要國家特留份立法進行研究,從中尋找我國遺囑繼承的可借鑒之處,同時結(jié)合我國現(xiàn)在國情和文化傳統(tǒng),將特留份制度與必留份并行,這樣我國未來遺囑自由限制制度才更切實可行。
[Abstract]:The special share system originates from Roman law, and its technology and application are maturing day by day. Most countries in the world make sure of it in the form of legislation. It plays an important role in restricting the testator's freedom of will, protecting the rights and interests of specific legal heirs and maintaining family ethics and social harmony. However, the system of special retention has not been established in the inheritance of our country, the restriction of the free will is relatively loose, the protection of the inheritance rights and interests of the heirs of the near relatives is insufficient, the specific provisions are rough and simple, and the operation is poor. It can no longer fully adapt to modern society. By studying the legislation of special retention in the main countries of the two legal systems, the author tries to find out the lessons of intestate succession in our country. At the same time, combining with the present situation and cultural tradition of our country, the system of special retention is parallel with that of mandatory. In this way, it is more feasible to restrict the freedom of wills in the future of our country.
