【摘要】：父母對(duì)未成年子女的監(jiān)護(hù)是我國(guó)監(jiān)護(hù)制度中的核心內(nèi)容,婚姻法中的相應(yīng)條款較為單薄,尤其是對(duì)父母離婚后的監(jiān)護(hù)問(wèn)題更是缺乏系統(tǒng)規(guī)范。為此,我們需要對(duì)現(xiàn)行立法中監(jiān)護(hù)制度的設(shè)置及其基本理念作重新的審視。
[Abstract]:The guardianship of minor children by parents is the core content of the guardianship system in our country, and the corresponding provisions in the Marriage Law are relatively weak, especially the problem of guardianship after the divorce of parents is lack of systematic regulation. Therefore, we need to re-examine the establishment and basic concept of guardianship system in current legislation.
