論夫妻忠誠協(xié)議的司法認(rèn)知

【摘要】：在社會的不斷變遷中,婚姻關(guān)系從過去的經(jīng)濟(jì)共同體、基于傳宗接代的動(dòng)因和目的向?yàn)榱藵M足夫妻雙方感情的要求轉(zhuǎn)變,任何婚婚姻中都不希望有不穩(wěn)定的因素存在,為了維系婚姻的正常秩序,夫妻雙方往往通過簽訂夫妻忠誠協(xié)議來限制破壞婚姻穩(wěn)定因素的發(fā)生,同時(shí)設(shè)立相應(yīng)的違約責(zé)任,以求達(dá)到時(shí)刻提醒夫妻雙方哪些行為是破壞婚姻和諧,對夫妻間不忠誠的行為產(chǎn)生一定的預(yù)防和威懾作用。《4婚姻法》是民法的一部分,秉承貫徹“私法自治”的原則,我國相應(yīng)法律法規(guī)并未明確禁止夫妻雙方就忠誠問題進(jìn)行平等約定,雙方只要是在平等自愿的原則下表達(dá)自身真實(shí)意愿,既不侵害第三方的利益,也有利于規(guī)范社會風(fēng)氣。夫妻忠誠協(xié)議是在公民自由權(quán)利和法律秩序間取得良好的平衡,為夫妻忠誠義務(wù)展開提供更好的法律指引、法律保護(hù),故夫妻忠誠協(xié)議的出現(xiàn)是符合社會發(fā)展的需要。本文從司法審判一線的角度出發(fā),探尋夫妻忠誠協(xié)議在司法實(shí)踐中出現(xiàn)的認(rèn)知困惑,分析夫妻忠誠協(xié)議出現(xiàn)的社會發(fā)展的原因及現(xiàn)實(shí)社會的需求,以及社會公眾對夫妻忠誠協(xié)議所產(chǎn)生的認(rèn)識誤區(qū)。同時(shí)收集我國現(xiàn)有審判案例,并進(jìn)行分析歸納,提煉出現(xiàn)有審判實(shí)踐對夫妻忠誠協(xié)議的司法認(rèn)知度,以及在審判實(shí)踐中遇到的待解決的法律問題,并結(jié)合國內(nèi)外先進(jìn)經(jīng)驗(yàn),在立足于我國現(xiàn)有國情的基礎(chǔ)上,探索出一系列針對當(dāng)前司法實(shí)踐中迫切需要解決的問題應(yīng)對之策,例如從司法確認(rèn)的要件、舉證責(zé)任的完善、違約責(zé)任的限定以及免責(zé)事由、公證制度的健全、法律制度的完善及法官自由裁量權(quán)的完善等方面分項(xiàng)進(jìn)行詳細(xì)分析,為司法實(shí)踐領(lǐng)域填補(bǔ)相應(yīng)的法律適用空白,力求為司法審判提供較為現(xiàn)實(shí)可行的參考。
[Abstract]:In the continuous changes of society, marriage relations have changed from the economic community in the past, based on the motives and purposes of successive generations, to meet the needs of the feelings of both husband and wife. In any marriage, there is no hope that there will be any unstable factors in marriage. In order to maintain the normal order of the marriage, the husband and wife often sign the agreement of the husband and wife loyalty to limit the occurrence of the destabilizing factors of the marriage, and establish the corresponding liability for breach of contract. In order to always remind the husband and wife which behavior is to destroy the marriage harmony, to produce certain prevention and deterrent effect to the disloyal behavior between husband and wife. < 4 Marriage Law > is part of the civil law, and adheres to the principle of "autonomy of private law". China's corresponding laws and regulations do not explicitly prohibit husband and wife from making equal agreement on loyalty. As long as both sides express their true will under the principle of equality and willingness, they will neither infringe the interests of third parties, but also help to regulate the social atmosphere. The agreement of husband and wife loyalty is to obtain a good balance between civil freedom rights and legal order, to provide better legal guidance and legal protection for husband and wife loyalty obligations, so the emergence of husband and wife loyalty agreement is in line with the needs of social development. From the point of view of judicial trial, this paper explores the cognitive confusion of marital loyalty agreement in judicial practice, and analyzes the reasons for the social development of marital loyalty agreement and the needs of the real society. And the misunderstanding of the public about the agreement of husband and wife loyalty. At the same time, we collect the existing trial cases in our country, analyze and sum up, refine the judicial recognition of the agreement of loyalty between husband and wife in trial practice, and the legal problems that need to be solved in the trial practice, and combine the advanced experience at home and abroad. Based on the current situation of our country, this paper explores a series of solutions to the urgent problems in the current judicial practice, such as the elements of judicial confirmation, the perfection of the burden of proof, the limitation of the liability for breach of contract and the reasons of exemption. The perfection of notarization system, the perfection of legal system and the consummation of the judge's discretion are analyzed in detail to fill the relevant blank of law application in the judicial practice field, and to provide practical and feasible reference for the judicial trial.
