【摘要】：近年來,隨著經(jīng)濟的發(fā)展,思想禁錮的解除和生活方式的變化,西方不良思想的影響,封建思想的沉渣泛起等多種原因,重婚行為已經(jīng)成為一個嚴重的社會問題,并有愈演愈烈的勢頭,其表現(xiàn)、成因呈多樣性、復雜性,對社會、家庭造成嚴重危害,而在司法實踐中,法院受理的重婚案件較少,因重婚行為而受到法律制裁的人更是鳳毛麟角。出現(xiàn)這種現(xiàn)象的原因是多種多樣的,但主要在于立法的滯后和混亂。 全文共五章,約四萬余字。 第一章:重婚罪的現(xiàn)狀、成因和危害。以廣州市為例,用翔實的數(shù)據(jù)說明當前重婚行為已日趨嚴重,其成因呈多樣性、復雜性,給社會、家庭造成嚴重的危害。以期引起全社會對重婚行為的重視,為預防和制止重婚行為構(gòu)筑有效的法律保障機制。 第二章:重婚罪的概念和構(gòu)成要件。闡述了重婚罪在中國的立法沿革,從重婚罪的構(gòu)成要件著眼,給重婚罪的概念一個科學的界定。 第三章:重婚罪的司法認定及處罰。從重婚罪與非罪的異同、與他罪的界限、以及《婚姻法》修改后對重婚罪認定的影響等幾方面闡述在司法實踐中對重婚如何準確認定,以利于對重婚的處罰。 第四章:重婚罪的訴訟程序。闡述了重婚罪訴訟的基本程序及在訴訟中應注意的問題和對現(xiàn)行立法的一點建議。 第五章:治理對策與建議。為有效預防和制止重婚行為不僅要健全和完善相關(guān)法律制度,而且還要建立健全社會防范體系。為此,結(jié)合實際提出可行性建議。
[Abstract]:In recent years, with the development of the economy, the lifting of ideological imprisonment and the change of life style, the influence of bad Western thoughts and the widespread sediment of feudal ideology, bigamy has become a serious social problem. And there is a growing momentum, its performance, the causes of diversity, complexity, causing serious harm to society and families, but in judicial practice, the court accepts fewer cases of bigamy, Legal sanctions for bigamy are even rarer. The reasons for this phenomenon are various, but mainly due to the lag and confusion of legislation. The full text has five chapters, about forty thousand words. Chapter one: the present situation, cause and harm of bigamy. Taking Guangzhou as an example, the present bigamy behavior has become more and more serious with full data. The causes of bigamy are diversity and complexity, which cause serious harm to society and family. In order to cause the whole society to pay attention to bigamy behavior, to prevent and stop bigamy behavior to build an effective legal protection mechanism. Chapter two: the concept and elements of bigamy. This paper expounds the legislative evolution of bigamy in China and gives a scientific definition of the concept of bigamy from the point of view of the constitution of bigamy. Chapter three: judicial confirmation and punishment of bigamy crime. From the aspects of the similarities and differences between bigamy and non-crime, the boundary between bigamy and other crimes, and the influence of the revision of Marriage Law on bigamy, this paper expounds how to identify bigamy accurately in judicial practice in order to benefit the punishment of bigamy. Chapter four: the procedure of bigamy. This paper expounds the basic procedure of bigamy lawsuit, the problems that should be paid attention to in the lawsuit and some suggestions on the current legislation. Chapter V: governance countermeasures and suggestions. In order to prevent and stop bigamy effectively, we should not only perfect and perfect the relevant legal system, but also establish and perfect the social prevention system. To this end, combined with the practical feasibility of the proposal.
