【摘要】：在兒童權(quán)益日益被強調(diào)的今天,收養(yǎng)作為保護兒童利益、為無家兒童提供一個和諧成長的環(huán)境的重要方式,漸漸引起了人們的廣泛關(guān)注。在整個收養(yǎng)體系中,區(qū)際收養(yǎng)是一種重要的收養(yǎng)形式。但隨之而來的區(qū)際收養(yǎng)方面的法律沖突,卻給法學(xué)界提出了新的課題。 為使區(qū)際收養(yǎng)這一民間法律行為有章可循,解決我國日益明顯的區(qū)際收養(yǎng)法律沖突,有效保護被收養(yǎng)兒童和其他收養(yǎng)當(dāng)事人的合法權(quán)益,筆者認為有必要對我國區(qū)際收養(yǎng)沖突的立法現(xiàn)狀和法律實踐進行探討。為此,筆者在導(dǎo)師的指導(dǎo)下,認真閱讀了大量的相關(guān)資料,比較深入的思考了該問題,對該問題的解決作了一些討論,完成了此篇碩士學(xué)位論文。 本文共分四章:第一章從收養(yǎng)法的概念入手,介紹了區(qū)際收養(yǎng)法律制度的概況,其中包括收養(yǎng)法、涉外收養(yǎng)法和區(qū)際收養(yǎng)法等不同方面。第二章通過對中國區(qū)際收養(yǎng)法律制度歷史沿革與現(xiàn)狀的介紹,討論了中國區(qū)際收養(yǎng)沖突出現(xiàn)的原因和自身的特點。鑒于中國四個法域收養(yǎng)立法的形成各有原因且相差很大,本章對中國內(nèi)地和香港、澳門、臺灣的收養(yǎng)法律制度的源流,分別進行了介紹和對比。第三章從收養(yǎng)成立的實質(zhì)要件、形式要件、收養(yǎng)的效力和收養(yǎng)關(guān)系的解除等幾個方面對中國區(qū)際收養(yǎng)法律制度進行了探討,具體分析了沖突產(chǎn)生的原因。第四章在前三章分析和討論的基礎(chǔ)上,提出了一些解決中國區(qū)際收養(yǎng)法律沖突的思路和方法,從而希望能對我國區(qū)際收養(yǎng)法律沖突的解決作出一些思考。
[Abstract]:Nowadays, children's rights and interests are being emphasized day by day. As an important way to protect the interests of children and provide a harmonious environment for the homeless children, adoption has gradually aroused people's widespread concern. In the whole adoption system, inter-regional adoption is an important form of adoption. However, the subsequent conflict of laws in the area of inter-regional adoption has put forward a new subject to the legal circle. In order to make the inter-regional adoption a folk legal act with rules to be followed, to resolve the increasingly obvious legal conflict of inter-regional adoption in China, and to effectively protect the legitimate rights and interests of adopted children and other adoptive parties, The author thinks it is necessary to probe into the legislation and practice of interregional adoption conflict in China. Therefore, under the guidance of the tutor, the author carefully read a large number of relevant materials, thought deeply about the problem, made some discussions on the solution of the problem, and completed the thesis of the master's degree. This paper is divided into four chapters: the first chapter introduces the general situation of the legal system of inter-regional adoption from the concept of adoption law, including the adoption law, foreign adoption law and inter-regional adoption law. The second chapter introduces the history and present situation of the legal system of inter-regional adoption in China, and discusses the causes and characteristics of the conflict of inter-regional adoption in China. In view of the different reasons for the formation of adoption legislation in the four jurisdictions of China, this chapter introduces and compares the legal systems of adoption in the mainland of China, Hong Kong, Macao and Taiwan. The third chapter discusses the legal system of inter-regional adoption in China from the aspects of substantive elements, formal elements, the effectiveness of adoption and the dissolution of adoptive relationship, and analyzes the causes of the conflict. On the basis of the analysis and discussion in the first three chapters, the fourth chapter puts forward some ideas and methods to solve the legal conflict of inter-regional adoption in China, hoping to make some thoughts on the solution of the legal conflict of inter-regional adoption in China.
