【摘要】： 法制建設(shè)的完善是近代以來中國追求現(xiàn)代化的目標(biāo)之一�？箲�(zhàn)時期的陜甘寧邊區(qū)，作為國民政府所屬特殊行政區(qū)域和中共中央所在地，其法制建設(shè)狀況為抗日戰(zhàn)爭研究中一個值得重視的歷史現(xiàn)象，且具有其特殊性。通過對抗戰(zhàn)時期陜甘寧邊區(qū)法制建設(shè)的研究，可以彌補(bǔ)以往對邊區(qū)法制建設(shè)研究的不足，有助于加強(qiáng)邊區(qū)研究和黨史研究工作。本文在吸收前人研究所取得成果的基礎(chǔ)上，對邊區(qū)法制建設(shè)狀況做了較為全面、深入的探討和研究。 首先，詳細(xì)敘述了抗日民族統(tǒng)一戰(zhàn)線的形成及其在邊區(qū)法制建設(shè)中的所起到的理論指導(dǎo)作用，并在大量借用前人研究成果的基礎(chǔ)上，初步勾勒出邊區(qū)立法工作中制訂的各項(xiàng)法律法規(guī)。通過分析邊區(qū)憲法性文件《陜甘寧邊區(qū)施政綱領(lǐng)》和選舉法、政權(quán)組織法、刑事法、土地法、訴訟法、婚姻法、勞動保護(hù)法等各項(xiàng)法規(guī)的制訂，指出立法中所取得的成就及其在完善邊區(qū)法制建設(shè)中所起到的重要作用，同時，對邊區(qū)立法工作中如經(jīng)濟(jì)、土地立法等表現(xiàn)出法制建設(shè)不健全的方面進(jìn)行初步探討。 其次，對邊區(qū)的司法機(jī)構(gòu)、審判制度、調(diào)解制度、刑罰制度、獄政制度進(jìn)行分析研究，通過對邊區(qū)司法制度的探討，以求得對于抗戰(zhàn)時期邊區(qū)的法制建設(shè)狀況有一個較為全面的了解，還歷史以本來面目。 再次，通過逐一分析邊區(qū)所制定的選舉法、政權(quán)組織法、刑事法、土地法、訴訟法、婚姻法、勞動保護(hù)法等法規(guī)的執(zhí)行情況，得出結(jié)論：邊區(qū)各項(xiàng)法規(guī)條例的執(zhí)行中取得了可喜的成績，，實(shí)現(xiàn)了邊區(qū)各階層人民的團(tuán)結(jié)，保障了邊區(qū)人民人權(quán)財(cái)權(quán)的安全，穩(wěn)定了邊區(qū)社會，擴(kuò)大與鞏固了邊區(qū)抗日民族統(tǒng)一戰(zhàn)線， 滿足了取得抗戰(zhàn)勝利的要求，促進(jìn)了邊區(qū)法制建設(shè)的完善工作。同時，對法律 執(zhí)行中未能全面貫徹、執(zhí)行各項(xiàng)法律，體現(xiàn)出邊區(qū)法制建設(shè)不成熟狀況的方面 進(jìn)行了探討工作，指明了各法規(guī)執(zhí)行中的不足之處。 最后，在本文的結(jié)論部分�？隙嗽诹⒎ā⑺痉ê蛨�(zhí)法中所取得的成就， 基本上完善了邊區(qū)法制建設(shè)，初步形成了抗日民主政權(quán)的新民主主義法律體 系。在承認(rèn)成績的同時，也指出了邊區(qū)法制建設(shè)的不成熟之處，總結(jié)了邊區(qū)在 立法、司法和執(zhí)法過程中的種種缺陷和不足，并就其戰(zhàn)時環(huán)境和邊區(qū)干部法律 知識的缺乏兩個主要原因進(jìn)行分析，探討其在邊區(qū)法制建設(shè)中的影響和作用。
[Abstract]:The perfection of legal system construction is one of the goals for China to pursue modernization since modern times. The Shensi-Kansu-Ningsia Border region in the period of Anti-Japanese War, as a special administrative region of the National Government and the seat of the CPC Central Committee, its legal system construction is a historical phenomenon worthy of attention in the study of the War of Resistance against Japan, and has its particularity. The research on the legal construction of the Shensi-Kansu-Ningsia Border region during the Anti-Japanese War period can make up for the deficiency of the previous research on the legal construction of the Border region and help to strengthen the research on the Border region and the Party's history. On the basis of absorbing the achievements of previous studies, this paper makes a comprehensive and in-depth study on the legal system construction in the border area. First of all, the formation of the anti-Japanese national United front and its theoretical guidance role in the legal construction of the border region are described in detail, and on the basis of a large number of previous research results, A preliminary outline of the border region in the legislative work to formulate laws and regulations. Through the analysis of the constitutional documents of the Border region "the Policy agenda of the Shensi-Kansu-Ningsia Border region" and the electoral law, the organic law of the political power, the criminal law, the land law, the procedural law, the marriage law, the labor protection law, and other laws and regulations, This paper points out the achievements made in the legislation and its important role in perfecting the legal system construction in the border area. At the same time, it makes a preliminary discussion on the imperfect legal system construction in the legislation work of the border region, such as economy and land legislation. Secondly, the judicial institutions, judicial system, mediation system, penalty system and prison system of the border region are analyzed and studied, and through the discussion of the judicial system in the border region, In order to obtain a more comprehensive understanding of the legal construction of the border region during the War of Resistance against Japan, and to return the history as it is. Thirdly, through the analysis of the implementation of the electoral law, the law of political power, the criminal law, the land law, the procedural law, the marriage law, the labor protection law and so on formulated in the border areas one by one, It is concluded that gratifying achievements have been made in the implementation of the laws and regulations of the Border region, which have realized the unity of the people of all strata of the Border region, guaranteed the security of the human rights and financial rights of the people of the Border region, and stabilized the society of the Border region. It has expanded and consolidated the anti-Japanese national United front in the Border region and met the requirements for victory in the War of Resistance. While acknowledging its achievements, it also points out the immaturity of the legal system in the border region, and sums up the defects and deficiencies in the legislative, judicial and law enforcement process of the border region. This paper also analyzes the two main reasons of its wartime environment and the lack of legal knowledge of cadres in the Border region, and probes into its influence and function in the legal construction of the Border region.
