【摘要】：婚姻登記是重要的法律制度,對(duì)于維護(hù)社會(huì)主義婚姻家庭制度具有重要意義。我國(guó)自1950年《婚姻法》施行以來,婚姻登記制度在維護(hù)婚姻關(guān)系的穩(wěn)定,促進(jìn)婚姻家庭和諧方面發(fā)揮了積極作用。隨著社會(huì)經(jīng)濟(jì)的發(fā)展,婚姻登記制度的社會(huì)經(jīng)濟(jì)價(jià)值正在日益顯現(xiàn)。但是,由于法律規(guī)范的缺失,因婚姻登記產(chǎn)生的社會(huì)問題越來越多。本文從行政法學(xué)的角度對(duì)婚姻登記的基本屬性和基本問題進(jìn)行研究,解析婚姻登記制度的本質(zhì)特征,為妥善解決婚姻登記爭(zhēng)議提出自己的觀點(diǎn)。 全文除引言和結(jié)論外,共分為四章。 第一章是關(guān)于婚姻登記性質(zhì)的論述,在概述婚姻登記的含義后,通過對(duì)比分析的方法,從行政許可、行政確認(rèn)、特殊的具體行政行為和行政公示四個(gè)方面分析了婚姻登記的法律性質(zhì),論述了婚姻登記的行政確認(rèn)的性質(zhì)。 第二章是關(guān)于婚姻登記效力的論述,從三個(gè)不同的角度論述了婚姻登記的效力。從實(shí)質(zhì)要件和程序要件兩個(gè)方面對(duì)瑕疵婚姻登記的效力進(jìn)行剖析,通過類型化分析和具體案例,揭示了《婚姻法》是確定婚姻登記效力的依據(jù),及立法對(duì)于瑕疵婚姻登記效力的認(rèn)可和補(bǔ)正的思路。 第三章是關(guān)于婚姻登記行政審查制度的論述,闡明了婚姻登記審查制度的意義,對(duì)當(dāng)前婚姻登記審查制度存在的問題進(jìn)行了深入剖析,針對(duì)有關(guān)婚姻登記審查方式的不同觀點(diǎn),結(jié)合立法宗旨和具體規(guī)定,說明了婚姻登記應(yīng)當(dāng)實(shí)行形式審查制度,并提出了完善婚姻登記形式審查制度的具體建議。 第四章是關(guān)于婚姻登記司法救濟(jì)的論述,介紹了婚姻登記案件的基本情況和司法實(shí)踐中的主要觀點(diǎn);對(duì)實(shí)踐中民事和行政交叉婚姻案件的審理方式進(jìn)行了法理思考和利弊分析,從可行性和行政效率兩個(gè)方面論述了直接通過民事訴訟審理民事和行政交叉婚姻案件的合理性。
[Abstract]:Marriage registration is an important legal system, which is of great significance to the maintenance of socialist marriage and family system. Since the implementation of the Marriage Law in 1950, the marriage registration system has played an active role in maintaining the stability of marriage relations and promoting marriage and family harmony. With the development of social economy, the social and economic value of marriage registration system is becoming more and more obvious. However, due to the lack of legal norms, more and more social problems arise from marriage registration. From the perspective of administrative law, this paper studies the basic attributes and problems of marriage registration, analyzes the essential characteristics of marriage registration system, and puts forward its own views for the proper resolution of marriage registration disputes. In addition to the introduction and conclusions, the full text is divided into four chapters. The first chapter is about the nature of marriage registration, after summarizing the meaning of marriage registration, through the method of comparative analysis, from the administrative licensing, administrative confirmation, This paper analyzes the legal nature of marriage registration and discusses the nature of administrative confirmation of marriage registration. The second chapter discusses the validity of marriage registration from three different angles. This paper analyzes the validity of defective marriage registration from two aspects: substantive and procedural elements, and reveals that the Marriage Law is the basis for determining the validity of marriage registration through type analysis and specific cases. And legislation for the registration of defective marriage recognition and correction of the train of thought. The third chapter discusses the administrative review system of marriage registration, clarifies the significance of marriage registration review system, deeply analyzes the problems existing in the current marriage registration review system, and aims at different views on the ways of marriage registration review. Combined with the legislative purpose and specific provisions, this paper explains that the formal examination system should be carried out in marriage registration, and puts forward some concrete suggestions for perfecting the formal examination system of marriage registration. The fourth chapter discusses the judicial relief of marriage registration, introduces the basic situation of marriage registration cases and the main points of view in judicial practice, and analyzes the legal principles and advantages and disadvantages of the trial methods of civil and administrative cross-marriage cases in practice. This paper discusses the rationality of hearing civil and administrative cross-marriage cases directly through civil litigation from two aspects of feasibility and administrative efficiency.
