【摘要】： 隨著經(jīng)濟(jì)和社會(huì)的發(fā)展,法制現(xiàn)代化成為現(xiàn)代化研究的熱點(diǎn)。婚姻法制現(xiàn)代化是法制現(xiàn)代化的重要組成部分,又因?yàn)榛橐龇ㄖ片F(xiàn)代化是法制現(xiàn)代化中涉及面最廣、與傳統(tǒng)倫理關(guān)系聯(lián)系最為密切的部分,所以婚姻法制現(xiàn)代化是法制現(xiàn)代化的基礎(chǔ)。婚姻法制現(xiàn)代化的進(jìn)程直接影響法制現(xiàn)代化的進(jìn)程。本文主要從以下幾個(gè)方面進(jìn)行探討和研究: 引言:概括本文的寫作背景和目的。 第一部分:首先,闡述現(xiàn)代化和法制現(xiàn)代化的涵義;其次,根據(jù)現(xiàn)代化與法制現(xiàn)代化的涵義,概括出婚姻法制現(xiàn)代化的涵義;再次,總結(jié)婚姻法制現(xiàn)代化的評(píng)判標(biāo)準(zhǔn):從婚姻法律規(guī)范、婚姻法律意識(shí)、婚姻法律行為三方面分析我國(guó)婚姻法制現(xiàn)代化的評(píng)判標(biāo)準(zhǔn)。婚姻法制現(xiàn)代化在婚姻法律規(guī)范方面的標(biāo)準(zhǔn)為:婚姻法律規(guī)范要具有妥當(dāng)性;婚姻法律規(guī)范要具有實(shí)效性;婚姻法律規(guī)范要具有確定性;婚姻法律規(guī)范要具有可訴性;婚姻法制結(jié)構(gòu)完備;婚姻法與上位法的原則、標(biāo)準(zhǔn)和規(guī)范之間應(yīng)當(dāng)協(xié)調(diào)一致,不能出現(xiàn)矛盾。在婚姻法律意識(shí)方面的標(biāo)準(zhǔn)為:婚姻法在婚姻關(guān)系調(diào)節(jié)中的權(quán)威意識(shí);婚姻平等意識(shí)和婚姻自由意識(shí);婚姻權(quán)利和義務(wù)意識(shí)。在婚姻法律行為方面的標(biāo)準(zhǔn)為:公民自覺(jué)遵守婚姻法;司法部門嚴(yán)格司法;執(zhí)法部門嚴(yán)格執(zhí)法;婚姻法律監(jiān)督、救助機(jī)制完善。 第二部分:通過(guò)對(duì)20世紀(jì)以來(lái)我國(guó)婚姻法制現(xiàn)代化的回顧進(jìn)一步論證婚姻法制現(xiàn)代化的趨勢(shì)和判斷標(biāo)準(zhǔn)。通過(guò)對(duì)20世紀(jì)早期、20世紀(jì)中期、20世紀(jì)中晚期以及21世紀(jì)初期四個(gè)時(shí)期的分別考察體現(xiàn)婚姻法制現(xiàn)代化的涵義和標(biāo)準(zhǔn)。 第三方面:從現(xiàn)實(shí)出發(fā),深入探討我國(guó)婚姻法制現(xiàn)代化進(jìn)程中,目前存在的問(wèn)題及其影響因素。這些問(wèn)題也主要存在于婚姻法律規(guī)范、婚姻法律意識(shí)、婚姻法律行為三個(gè)方面。我國(guó)婚姻法制雖然已經(jīng)取得了很大成就,但是在以上三個(gè)方面仍然存在著需要解決的問(wèn)題。這些問(wèn)題背后存在著諸多原因:經(jīng)濟(jì)發(fā)展水平及各地區(qū)發(fā)展不平衡是影響婚姻法制現(xiàn)代化進(jìn)程的根本因素;中西婚姻法律文化異質(zhì)沖突是影響我國(guó)婚姻法制現(xiàn)代化進(jìn)程的主要因素;傳統(tǒng)因素的影響是婚姻法制現(xiàn)代化存在問(wèn)題的主要原因;我國(guó)國(guó)情是我國(guó)婚姻法制現(xiàn)代化進(jìn)程的直接影響因素;法律教育發(fā)展的緩慢是影響我國(guó)婚姻法制現(xiàn)代化的進(jìn)程的間接因素。 第四部分,根據(jù)當(dāng)今我國(guó)在婚姻法制現(xiàn)代化進(jìn)程中存在的問(wèn)題,提出我國(guó)婚姻法制現(xiàn)代化的實(shí)現(xiàn)途徑:加快經(jīng)濟(jì)的發(fā)展是實(shí)現(xiàn)我國(guó)婚姻法制現(xiàn)代化的經(jīng)濟(jì)基礎(chǔ);法律移植是我國(guó)婚姻法制現(xiàn)代化的必要手段;吸收我國(guó)傳統(tǒng)文化中的合理部分,樹(shù)立現(xiàn)代婚姻法律意識(shí)是我國(guó)婚姻法制現(xiàn)代化的重要途徑;依據(jù)我國(guó)國(guó)情,建立完備的法律體系是實(shí)現(xiàn)我國(guó)婚姻法制現(xiàn)代化的基礎(chǔ);加強(qiáng)法制教育是我國(guó)婚姻法制現(xiàn)代化的重要手段。 結(jié)束語(yǔ):通過(guò)本文的探討,得出結(jié)論:在建設(shè)法制現(xiàn)代化的進(jìn)程中,必須打好婚姻法制現(xiàn)代化這個(gè)基礎(chǔ),解決婚姻法制現(xiàn)代化過(guò)程中的問(wèn)題,加速婚姻法制現(xiàn)代化的進(jìn)程,以促進(jìn)經(jīng)濟(jì)和社會(huì)的現(xiàn)代化進(jìn)程。
[Abstract]:With the development of economy and society, the modernization of the legal system has become a hot spot in the study of modernization. The second part: through the review of the modernization of marriage legal system in China since twentieth Century, the trend and criterion of marriage legal modernization are further demonstrated. The meaning and standards of the modernization of marriage legal system are reflected through the four periods of early twentieth Century, mid twentieth Century, middle and late twentieth Century and early twenty-first Century.
The third aspect: from the reality, the present problems and the influencing factors in the process of the modernization of marriage legal system in China are discussed in depth. These problems are also mainly existed in the legal norms of marriage, the consciousness of marriage law and the legal behavior of marriage in three aspects. Although the marriage legal system has made great achievements in our country, it is still in the three aspects. There are many problems that need to be solved. There are many reasons behind these problems: the level of economic development and the unbalanced development of various regions are the fundamental factors that affect the modernization of marriage legal system; the heterogeneous conflict between Chinese and western marriage legal culture is the main factor affecting the process of the modernization of marriage legal system in China; the influence of traditional factors is the marriage law. The main reason for the problems in the modernization of the system is that the national conditions of our country are the direct factors affecting the modernization of the marriage legal system in our country, and the slow development of the legal education is the indirect factor affecting the process of the modernization of the marriage legal system in China.
The fourth part, according to the existing problems in the process of modernization of marriage legal system in our country, put forward the way to realize the modernization of marriage legal system in our country: accelerating the economic development is the economic basis for realizing the modernization of the marriage legal system in our country; the legal transplantation is the necessary means for the modernization of the marriage legal system of our country; it absorbs the reasonable part of our traditional culture. Establishing a modern marriage legal consciousness is an important way to modernize the legal system of marriage in China. According to the national conditions of our country, establishing a complete legal system is the basis for the realization of the modernization of our marriage legal system, and the strengthening of legal education is an important means of the modernization of marriage legal system in our country.
