【摘要】：我們國家現(xiàn)行婚姻法頒布的時間較早,是在2001年頒布的,加上夫妻對外債務(wù)問題的內(nèi)容變化復(fù)雜。因此,相關(guān)法制就存在一定的滯后性,導(dǎo)致夫妻債務(wù)不少問題出現(xiàn)立法的空缺或規(guī)定不夠細(xì)致的地方。本文從這個角度出發(fā),以個案研究、歷史研究、比較研究和文獻(xiàn)研究的方法,通過比較我國大陸以及國外與臺灣地區(qū)的夫妻債務(wù)不同規(guī)定,分析我國大陸相應(yīng)法制面臨的些許問題,最后再參考廣大學(xué)者的觀點,提出筆者淺顯的見解與建議。本文結(jié)構(gòu)由下面五個部分組成：第一部分是由一個案例引出的問題。從一個案件一審與二審的不同判決中分析當(dāng)今司法審判的共性問題和發(fā)展趨勢,總結(jié)出我國夫妻對外共同債務(wù)認(rèn)定的爭議。第二部分為夫妻債務(wù)的簡單概述。包含夫妻財產(chǎn)制與夫妻債務(wù)的關(guān)系、夫妻對外個人債務(wù)與共同債務(wù)的關(guān)系。第三部分為夫妻債務(wù)的法制史考察與比較。分析了中國大陸夫妻債務(wù)的立法發(fā)展。對外國和臺灣地區(qū)的夫妻債務(wù)規(guī)定進(jìn)行了闡述,并與我國的規(guī)定進(jìn)行分析比較,總結(jié)出境外規(guī)定的進(jìn)步之處,來供我們借鑒學(xué)習(xí)。第四部分為我國大陸夫妻債務(wù)相應(yīng)法制呈現(xiàn)出的問題。從第一部分的案例裁判實踐與第三部分的法制規(guī)定,來分析相應(yīng)法制呈現(xiàn)出的問題。比如,夫妻對外的個人債務(wù)與共同債務(wù)的界限不明確,缺少日常家庭內(nèi)部事務(wù)的代理權(quán)與分居階段的相應(yīng)規(guī)定等等,導(dǎo)致我國司法裁判在夫妻對外債務(wù)糾紛上存在一定的認(rèn)定困境。第五部分是完善我國大陸夫妻的共同債務(wù)法制規(guī)定的若干提議。通過以上分析及比較,提出使我國大陸法制關(guān)于夫妻對外共同債務(wù)規(guī)則趨于完備的一些提議。比如,夫妻對外共同債務(wù)的規(guī)范定位、明確范圍,建立日常家庭事務(wù)代理制和調(diào)整舉證責(zé)任分配等等。
[Abstract]:Our country's current marriage law was enacted earlier, in 2001, coupled with the complex changes in the content of the external debt of husband and wife. Therefore, there is a lag in the related legal system, which leads to the lack of legislation or the lack of detailed provisions. From this point of view, with the methods of case study, historical study, comparative study and literature study, this paper compares the different provisions of husband and wife debt between mainland China and foreign countries and Taiwan. This paper analyzes some problems facing the corresponding legal system in mainland China, and finally, referring to the views of the majority of scholars, puts forward the author's simple opinions and suggestions. The structure of this paper is composed of the following five parts: the first part is the question raised by a case. This paper analyzes the common problems and development trends of current judicial trials from different judgments of a case of first instance and second instance, and summarizes the dispute on the recognition of common debts between husband and wife in China. The second part is a brief summary of husband and wife debt. It includes the relationship between husband and wife property system and husband and wife debt, and the relationship between husband and wife external personal debt and joint debt. The third part is the investigation and comparison of the legal history of husband and wife debt. This paper analyzes the legislative development of husband and wife debt in mainland China. This paper expounds the stipulation of husband and wife debt in foreign countries and Taiwan, and compares it with the provisions of our country, and sums up the progress of overseas regulations, which can be used for reference and study. The fourth part is the problem of the corresponding legal system of husband and wife debt in mainland China. From the first part of the practice of case adjudication and the third part of the legal provisions, to analyze the corresponding legal problems. For example, the boundary between the personal debt and the common debt of husband and wife is not clear, the agency power of daily family internal affairs is lacking and the corresponding provisions of the separation phase are lacking, etc. As a result, the judicial decision in China in the external debt disputes between husband and wife, there are certain difficulties. The fifth part is a number of proposals to perfect the common debt legal system of mainland China. Based on the above analysis and comparison, some suggestions are put forward to make the rules of mutual debt between husband and wife tend to be perfect in China's mainland legal system. For example, the common debt of husband and wife, clear scope, establish daily family affairs agency system and adjust the distribution of burden of proof and so on.
