【摘要】：法的確定性一直以來都是法律人為之追求的目標(biāo)。而關(guān)于法的不確定性的爭論也并未停止,相信今后這樣的爭論還會繼續(xù)進行下去。本文以法的確定性為切入點,在立法語境下,結(jié)合語言學(xué)相關(guān)理論,探討法的確定性與立法語言之間的邏輯關(guān)系,同時借以《婚姻法》為研究對象,最終在具體操作層面上歸納出如何實現(xiàn)法的確定性的立法語言選擇標(biāo)準(zhǔn)。 第一部分是介紹立法語境下對法的確定性的界定。首先劃定關(guān)于法的確定性問題的討論范圍,通過對法律現(xiàn)實主義和語言哲學(xué)的評述,得出這樣的結(jié)論：法的確定性其實就是法律條文經(jīng)由語言文字所表達的含義具有確定性、客觀性,同時更應(yīng)看到我們所追求的確定是一種相對的確定,以及追求確定性在我國當(dāng)下的現(xiàn)實意義。承接上文,既然追求法的確定性是立法過程中的重要目標(biāo),文章第二部分主要是通過對立法語言的本體研究揭示立法語言與法的確定性的邏輯關(guān)系,兩者是如何互動、互為影響。作為實現(xiàn)法的確定性的基礎(chǔ)和前提,立法語言的語體風(fēng)格是怎樣體現(xiàn)法的確定性；第三部分為文章的主體,以《婚姻法》為范例,探討立法過程中,立法語言實現(xiàn)法的確定性的語言選擇標(biāo)準(zhǔn),文章最后落腳在制度化的途徑歸納中。 通過前期資料搜集,筆者發(fā)現(xiàn)從各種視角出發(fā)研究法的確定性這一問題著實成果豐碩,而對立法語言本體的關(guān)注和研究,立法學(xué)界和語言學(xué)界也在不同層而鋪開,但的確很少有將這兩個問題聯(lián)系在一起,從法的確定性與立法語言的邏輯關(guān)系這個角度為切入點,這正是本文的創(chuàng)新點所在。本文的邏輯結(jié)構(gòu)開篇涉及理論比較抽象和宏觀,行文至主體部分結(jié)合具體的法律來論述如何通過立法語言的選擇實現(xiàn)法的確定性,最后歸納出實現(xiàn)法的確定性的方法�！痘橐龇ā芳仁潜疚牡姆治鰧ο笥肿鳛橐粋�分析工具,理論與文本相結(jié)合,既有說理又有實證,避免將文章寫成僅從遣詞造句的角度利用語法理論來簡單分析立法文本中的語用錯誤。
[Abstract]:The certainty of law has always been the goal pursued by legal people. And the debate about the uncertainty of law has not stopped, and I believe it will continue in the future. This paper takes the certainty of law as the starting point, in the context of legislation, combining with the relevant theories of linguistics, probes into the logical relationship between the certainty of law and the legislative language, and takes Marriage Law as the object of study. Finally, on the level of concrete operation, it concludes the choice standard of legislative language how to realize the certainty of law. The first part is to introduce the definition of legal certainty in the context of legislation. First of all, the scope of discussion on the certainty of law is defined. Through the comments on legal realism and linguistic philosophy, the conclusion is drawn that the certainty of law is in fact the certainty of the meaning expressed by the text of the law through the language. Objectivity, at the same time, we should see that the determination we seek is a relative certainty, and the realistic significance of seeking certainty in our country. To undertake the above, since the pursuit of legal certainty is an important goal in the legislative process, the second part of the article mainly reveals the logical relationship between the legislative language and the certainty of law through the ontological study of the legislative language, and how the two interact with each other. Influence each other. As the basis and premise of realizing the certainty of the law, how does the style of the legislative language embody the certainty of the law? the third part is the subject of the article, taking the Marriage Law as an example to explore the legislative process. The deterministic language choice standard of legislative language realization law is concluded in the institutionalization approach at the end of the article. Through the early data collection, the author finds that the research on the certainty of law from various perspectives is fruitful, and the attention and research on the ontology of legislative language are also spread in the field of law and linguistics at different levels. However, few of these two problems are linked together, from the angle of legal certainty and the logical relationship between legislative language, which is the innovation of this paper. The logical structure of this paper is related to the abstract and macroscopical theory. The author discusses how to realize the certainty of the law through the choice of legislative language, from the main part to the subject part, combining with the specific law. Finally, it concludes the method of realizing the certainty of the law. Marriage Law is not only the object of this article but also a tool for analysis. The combination of theory and text has both reasoning and demonstration. Avoid writing the article as a simple analysis of pragmatic errors in legislative texts from the perspective of sentence making and grammatical theory.
