【摘要】： 最高人民法院關(guān)于適用《中華人民共和國婚姻法》若干問題的解釋(二)第十條對彩禮返還做出了具體規(guī)定,但卻沒有對理論界和實務(wù)界爭論的彩禮性質(zhì)予以認定,國內(nèi)外關(guān)于彩禮的性質(zhì)存在不同的學說。當前,關(guān)于彩禮的立法存在諸多缺陷,如用語“共同生活”難以確定和舉證;訴訟主體不明確;沒有充分考慮婦女權(quán)益的保護;部分司法解釋相沖突等。本文從彩禮的起源出發(fā),通過分析其歷史演進,得出在現(xiàn)代法律體系下,彩禮的法律性質(zhì)是附解除條件的贈與,所附的解除條件是法定婚姻未締結(jié)。只有明確彩禮的性質(zhì),將其納入我國的部門法體系,立足于客觀現(xiàn)實,尊重歷史傳統(tǒng)和文化傳承,從保護婦女權(quán)益和婚姻自由原則出發(fā),才能明確彩禮的范圍、訴訟主體和時效,最終完善我國的彩禮立法,發(fā)揮法律的定紛止爭作用。
[Abstract]:Interpretation by the Supreme people's Court on the Application of the Marriage Law of the people's Republic of China (2) Article 10 makes specific provisions on the return of the bride price, but does not confirm the nature of the bride price as disputed in the theoretical and practical circles. There are different theories about the nature of bride price at home and abroad. At present, there are many defects in the legislation on bride price, such as the difficulty of determining and proving the expression "living together", the ambiguity of the subject of litigation, the failure to take full account of the protection of women's rights and interests, the conflict of some judicial interpretations and so on. Starting from the origin of the bride price and analyzing its historical evolution, this paper concludes that under the modern legal system, the legal nature of the bride price is a gift with the conditions of dissolution, and the attached condition of dissolution is that the legal marriage is not concluded. Only by making clear the nature of the bride price, bringing it into the department law system of our country, based on the objective reality, respecting the historical tradition and cultural heritage, and proceeding from the principles of protecting the rights and interests of women and the freedom of marriage, can the scope of the bride price be clearly defined. Litigation subject and statute of limitations, the final perfection of China's bride price legislation, play a role in the settlement of disputes.
