物權(quán)法視角下的夫妻共有房屋的認(rèn)定與處分

【摘要】: 《物權(quán)法》的實(shí)施,對(duì)家庭財(cái)產(chǎn)關(guān)系產(chǎn)生了重要的影響。本文主要圍繞一個(gè)案例展開對(duì)夫妻共有房屋認(rèn)定與處分的相關(guān)論述。之所以把夫妻共有房屋從眾多家庭財(cái)產(chǎn)中獨(dú)立出來進(jìn)行論述,主要是由于房屋作為不動(dòng)產(chǎn),價(jià)值較大,是家庭財(cái)產(chǎn)的重要組成部分,對(duì)于維系家庭的存續(xù)和穩(wěn)定,具有重要作用。 文章首先對(duì)一個(gè)物權(quán)法案件進(jìn)行評(píng)析,列出了合議庭的兩種不同意見,以及法院的最終判決結(jié)果。 其次,文章解析了《物權(quán)法》施行前后,對(duì)此類案件的不同處理態(tài)度!段餀(quán)法》施行之前,對(duì)此類案件的處理主要根據(jù)的是《婚姻法》及《民法通則》的相關(guān)規(guī)定,對(duì)于夫妻共有房屋應(yīng)由雙方共同處分,一方擅自處分屬于無權(quán)處分;而《物權(quán)法》施行之后,首次在法律上確定了不動(dòng)產(chǎn)的善意取得制度,即:房屋權(quán)屬證書上登記的權(quán)利人擅自處分夫妻共有房屋的,第三人在善意且無過失的情況下,可依善意取得制度取得房屋所有權(quán)。 再次,文章對(duì)《物權(quán)法》涉及到的夫妻共有房屋認(rèn)定與處分的相關(guān)理論進(jìn)行了論述,包括物權(quán)公示原則、善意取得制度以及共有制度,并與《婚姻法》相關(guān)規(guī)定進(jìn)行了比較,對(duì)于二者之間的沖突進(jìn)行了評(píng)價(jià),認(rèn)為二者并不存在實(shí)質(zhì)意義上的沖突。 最后,文章在對(duì)我國(guó)房屋所有權(quán)登記要求、現(xiàn)狀及弊端進(jìn)行分析的基礎(chǔ)上,提出了保護(hù)夫妻共有房屋所有權(quán)的幾點(diǎn)建議。
[Abstract]:The implementation of the Real right Law has had an important impact on family property relations. This paper mainly focuses on a case to discuss the identification and disposition of the couple's common house. The reason why the couple's common house is independently discussed from many family properties is mainly because the house, as a real estate, is of great value and is an important part of the family property. It is important to maintain the survival and stability of the family. Play an important role. This paper first analyzes a real right law case, lists two different opinions of the collegial panel and the final judgment result of the court. Secondly, the article analyzes the different attitudes to this kind of cases before and after the implementation of the property Law. Before the implementation of the Real right Law, the handling of such cases is mainly based on the relevant provisions of the Marriage Law and the General principles of Civil Law. For the joint disposition of a couple's common house, one party's unauthorized disposition is not entitled; and after the implementation of the property Law, the system of acquisition of real estate in good faith has been legally established for the first time. Namely: the owner of the right registered on the certificate of ownership of the house disposes of the joint house without authorization, the third party can acquire the ownership of the house according to the system of bona fide acquisition in good faith and no fault. Thirdly, the article discusses the related theories of the identification and disposition of the common house of husband and wife, including the principle of publicity of real right, the system of acquisition in good faith and the system of joint ownership, and compares with the relevant provisions of the Marriage Law. The conflict between them is evaluated and it is concluded that there is no real conflict between them. Finally, based on the analysis of the requirements, present situation and disadvantages of housing ownership registration in China, this paper puts forward some suggestions to protect the joint house ownership of husband and wife.
