【摘要】：對福建省大田縣的調查顯示,農(nóng)村彩禮呈現(xiàn)高額化的趨勢,影響婚姻自由、贍養(yǎng)關系和婚后生活,引發(fā)的糾紛日益增多。彩禮費用主要由男方父母支付,大多轉化為女方兄弟的結婚費用或被女方父母占有。影響彩禮數(shù)額的因素包括當?shù)氐慕?jīng)濟水平、性別比例和男女雙方的自身條件等。大多數(shù)人認可彩禮,并認為它是對父母養(yǎng)育之恩的報答和對女方父母的補償,而且老年人更多地對高額彩禮持肯定態(tài)度。高額彩禮的存在與傳統(tǒng)習俗、小農(nóng)意識和封建觀念、婚后女兒不再履行對父母的贍養(yǎng)義務有關。遏制彩禮高額化應當加強法律宣傳,營造反對高額彩禮的氛圍,依法打擊借婚姻索取財物的違法行為,積極完善我國有關彩禮的立法。
[Abstract]:A survey of Datian County in Fujian Province shows that the bride price in rural areas shows a tendency of high price, which affects the freedom of marriage, maintenance and life after marriage, which leads to more disputes. The bride price is mainly paid by the husband's parents, most of which are converted into the marriage expenses of the woman's brother or occupied by the woman's parents. The factors influencing the amount of bride price include local economic level, sex ratio and the condition of both men and women. Most people recognize the bride price as a reward for their parents' care and compensation for the woman's parents, and older people are more positive about the high price of the bride price. The existence of high bride price is related to the traditional custom, small farmer's consciousness and feudal idea, and the daughter's no longer fulfill the support duty to the parents after marriage. To curb the high price of bride price, we should strengthen legal propaganda, create an atmosphere against high bride price, crack down on the illegal behavior of obtaining property by marriage according to law, and actively perfect the legislation on bride price in our country.
