【摘要】：婚內強迫性交行為指婚姻關系存續(xù)期間,丈夫以暴力、脅迫或者其他手段,違背妻子意志,強迫妻子性交的行為,包括婚內一般強迫性交行為和婚內嚴重強迫性交行為。婚內強迫性交行為不等同于婚內強迫性行為和婚內強奸。婚內一般強迫性交行為由婚姻法和倫理道德調整;對婚內嚴重強迫性交行為,刑法可以明確規(guī)定為犯罪,罪名可確定為婚內強奸罪,并根據情節(jié)的嚴重程度適用不同的法定刑。
[Abstract]:The forced intercourse in the marriage refers to the behavior of violence , coercion or other means , which is contrary to the will of the wife and the sexual intercourse of the wife . The forced intercourse in the marriage is not equal to the marital rape and the marital rape . The forced intercourse within the marriage is not equal to the marital rape and the marital rape . The forced intercourse within the marriage is not equal to the marital rape and the marital rape . The marital rape is a serious compulsive intercourse , the criminal law can be clearly defined as the crime , the crime can be determined as the rape of marital rape , and the different statutory punishment can be applied according to the seriousness of the circumstances .
