【摘要】：社會(huì)由人組成，人以家庭的形式生活，婚姻是家庭的基礎(chǔ)和保障，男女雙方通過締結(jié)婚姻的方式來維系和保護(hù)彼此之間的人身關(guān)系和財(cái)產(chǎn)關(guān)系，從而產(chǎn)生了法律上的夫妻之間的權(quán)利義務(wù)關(guān)系。夫妻財(cái)產(chǎn)是夫妻婚姻家庭生活的物質(zhì)保障，婚姻家庭生活中又必定與第三人發(fā)生民事交易，為了確保夫妻地位平等和婚姻生活的正常運(yùn)轉(zhuǎn)，并保障第三人與夫妻交易的安全，維護(hù)社會(huì)秩序，法律設(shè)立了夫妻財(cái)產(chǎn)制，以調(diào)整夫妻財(cái)產(chǎn)關(guān)系。 隨著我國社會(huì)經(jīng)濟(jì)的發(fā)展，財(cái)富載體日趨多元化，投資渠道更加多樣化，夫妻財(cái)產(chǎn)也日益豐富多樣，相應(yīng)地，夫妻之間的財(cái)產(chǎn)關(guān)系也變得越來越復(fù)雜。所以，在現(xiàn)在這個(gè)社會(huì)，人和人之間的關(guān)系變得不再那么受重視，而財(cái)產(chǎn)關(guān)系卻變得越來越受人關(guān)注，人們對(duì)夫妻財(cái)產(chǎn)權(quán)益的重視程度也開始逐漸加強(qiáng)。在家庭和社會(huì)生活中，夫妻財(cái)產(chǎn)權(quán)的關(guān)鍵性作用日益凸顯。 夫妻財(cái)產(chǎn)制度是婚姻法的重要組成部分，其內(nèi)容主要包括夫妻財(cái)產(chǎn)制度的設(shè)立、變更與廢止，夫妻婚前財(cái)產(chǎn)和婚后所得財(cái)產(chǎn)的歸屬、管理、使用、收益、處分，以及家庭生活費(fèi)用的負(fù)擔(dān)，夫妻債務(wù)的清償，婚姻終止時(shí)夫妻財(cái)產(chǎn)的清算和分割等。 我國夫妻財(cái)產(chǎn)制度經(jīng)過1950年、1980年、2001年《婚姻法》的頒布及修訂，以及最高人民法院為指導(dǎo)司法實(shí)踐而先后作出的三個(gè)司法解釋的頒布，內(nèi)容逐漸豐富與具體，形成了一定的夫妻財(cái)產(chǎn)制度立法體系，但隨著社會(huì)與經(jīng)濟(jì)的發(fā)展，需要調(diào)整的夫妻財(cái)產(chǎn)關(guān)系新情況不斷出現(xiàn)，我國現(xiàn)行的夫妻財(cái)產(chǎn)制度顯然仍存有缺陷及不足。 本文對(duì)1950年到2011年期間，《婚姻法》至《婚姻法解釋（三）》（最高人民法院）推行的演變過程中，法律上對(duì)夫妻財(cái)產(chǎn)權(quán)的相關(guān)條款，進(jìn)行了回顧；對(duì)每一時(shí)期的不同表現(xiàn)進(jìn)行了簡要分析，同時(shí)縱向比較了每一階段的夫妻財(cái)產(chǎn)權(quán)，對(duì)國內(nèi)相關(guān)法律現(xiàn)狀和立法變遷進(jìn)行了分析，從而發(fā)現(xiàn)與社會(huì)發(fā)展相應(yīng)，夫妻財(cái)產(chǎn)權(quán)利不斷變遷的整體規(guī)律。并且，本文對(duì)國外一些相關(guān)法律條款進(jìn)行了介紹，希望借助橫向比較，，從不同的角度，對(duì)我國夫妻財(cái)產(chǎn)權(quán)的不足作出研究，同時(shí)找到解決方案。
[Abstract]:Society is made up of people who live in the form of a family. Marriage is the foundation and security of the family, and both men and women maintain and protect their personal and property relationships by entering into marriage. Thus the legal relationship between the rights and obligations of husband and wife. The property of husband and wife is the material guarantee of marital and family life of husband and wife. In order to ensure the equality of marital status and the normal operation of marital life, and to ensure the safety of the transaction between the third person and the husband and wife, the civil transaction must take place with the third party in the marriage and family life. In order to maintain social order, the law established the marital property system to adjust the marital property relationship. With the development of China's social economy, the wealth carrier is becoming more and more diversified, the investment channels are more diversified, and the marital property is becoming more and more diverse. Accordingly, the property relationship between husband and wife is becoming more and more complex. Therefore, in this society, the relationship between people has become less attention, but the property relationship has become more and more concerned, people pay more and more attention to the property rights and interests of husband and wife. In the family and social life, the key role of marital property rights is increasingly prominent. The matrimonial property system is an important part of the Marriage Law. Its contents mainly include the establishment, modification and abolition of the matrimonial property system, the ownership, management, use, income and disposition of the matrimonial property and the property acquired after marriage. And the burden of family living expenses, the settlement of husband and wife debt, the liquidation and division of marital property at the end of marriage. After the promulgation and revision of the Marriage Law in 1950, 1980 and 2001, and the promulgation of three judicial interpretations successively made by the Supreme people's Court to guide judicial practice, the contents are gradually enriched and specific. A certain legislative system of husband and wife property system has been formed, but with the development of society and economy, the new situation of husband and wife property relationship that needs to be adjusted appears constantly, and the current marital property system of our country still has obvious defects and deficiencies. From 1950 to 2011, in the course of the evolution of the Marriage Law to the interpretation of the Marriage Law (3) (the Supreme people's Court), the article reviews the relevant provisions of the husband and wife's property rights in the law of "Marriage Law" and "interpretation of the Marriage Law" (3) (Supreme people's Court). The different performance of each period is briefly analyzed, at the same time, the property rights of husband and wife in each stage are compared vertically, and the current situation of domestic relevant laws and legislative changes are analyzed, and the corresponding social development is found. Husband and wife property rights constantly changing the overall law. In addition, this paper introduces some relevant legal provisions in foreign countries, hoping to study the shortage of property rights of husband and wife in China from different angles with the help of horizontal comparison, and find solutions at the same time.
