保安族婚姻繼承習(xí)俗與國(guó)家法的協(xié)調(diào)機(jī)制研究

【摘要】:保安族受其宗教信仰的影響,同時(shí)在與其他少數(shù)名族交往融合的過程中,形成了具有本民族特色的婚姻繼承風(fēng)俗,是約束保安族人民普遍遵守的重要行為規(guī)范,最集中、典型地反映了保安族民族的特色。本文通過對(duì)個(gè)案的分析,梳理了保安族具體的婚姻繼承習(xí)俗,在此基礎(chǔ)上得出以下結(jié)論:由于保安族人口稀少,聚居地地理位置特殊,與外部交流不暢,便形成了用以處理本民族內(nèi)部糾紛矛盾的調(diào)節(jié)機(jī)制,具有地域性、自發(fā)性、民族性、宗教性等特征。這種民間調(diào)節(jié)機(jī)制代代傳承,是保安族群眾解決糾紛的首要選擇。 但保安族婚姻繼承習(xí)俗中例如婚姻締結(jié)的條件、程序、繼承財(cái)產(chǎn)的范圍、順序等都與國(guó)家法產(chǎn)生了較大的差異,使得國(guó)家在民族自治地方推行法治建設(shè)遇到了不小的阻礙,無法達(dá)到法律效果與社會(huì)效果相統(tǒng)一的局面。因此在社會(huì)轉(zhuǎn)型期間,為了更好地推行法治建設(shè),并且嘗試將保安族婚姻繼承習(xí)俗中的優(yōu)良成份上升為具有更廣泛效力的行為規(guī)范,從而實(shí)現(xiàn)被廣大保安族群眾接納遵守、并對(duì)國(guó)家法起到一定補(bǔ)充作用的目的,這是一項(xiàng)勢(shì)在必行的研究。本文將從以下三個(gè)章節(jié)分別進(jìn)行論述。 第一章通過實(shí)地考察所得的第一手資料,介紹保安族族源、族名的來歷等,闡述保安族婚姻繼承習(xí)俗的背景和內(nèi)因因素,并梳理了保安族婚姻繼承習(xí)俗的具體內(nèi)容。 第二章通過總結(jié)第一章的內(nèi)容,,分析保安族婚姻繼承習(xí)俗的適用現(xiàn)狀,對(duì)保安族婚姻繼承習(xí)俗與國(guó)家法關(guān)系進(jìn)行對(duì)比,主要從二者的沖突方面展開。在此基礎(chǔ)上對(duì)二者協(xié)同的可能性進(jìn)行分析,以引起下一章節(jié)對(duì)協(xié)調(diào)路徑的思考。 第三章通過以上章節(jié)的分析得出結(jié)論:通過立法、執(zhí)法、司法三個(gè)方面,國(guó)家法應(yīng)吸收保安族婚姻繼承習(xí)俗中合理因素,而保安族自身也應(yīng)做出轉(zhuǎn)變,增補(bǔ)刪減宗教條例來順應(yīng)國(guó)家法治的統(tǒng)一性要求,以期實(shí)現(xiàn)國(guó)家法和民族習(xí)俗的協(xié)調(diào)統(tǒng)一。
[Abstract]:Under the influence of their religious beliefs, and in the process of communication and integration with other minority ethnic groups, the security ethnic group has formed the custom of marriage and inheritance with its own characteristics, which is an important code of conduct that constrains the common observance of the people of the minority nationality, and is the most concentrated. Typical reflects the characteristics of the security nationality. Based on the analysis of the individual cases, this paper combs the specific customs of marriage and inheritance of the Gongan nationality, and draws the following conclusions: due to the small population, the special geographical location of the inhabited area, and the difficulty of communicating with the outside, It formed a regulating mechanism to deal with the internal disputes of the nation, with regional, spontaneous, national, religious and other characteristics. This kind of folk regulation mechanism inherits from generation to generation, is the first choice that the security nationality populace solves the dispute. However, the customs of marriage inheritance of the security nationality, such as the conditions of marriage conclusion, the procedure, the scope and the order of inheritance, all have great differences with the national law, which makes the country face no small obstacles in carrying out the construction of the rule of law in the national autonomous areas. Cannot achieve the legal effect and the social effect unifies the situation. Therefore, during the period of social transformation, in order to better promote the construction of the rule of law, and to try to raise the fine elements of the marriage inheritance custom of the security group into a more effective code of conduct, so as to achieve acceptance and compliance by the broad masses of the security people. And play a supplementary role in the purpose of national law, this is an imperative study. This article will be discussed from the following three chapters. The first chapter introduces the origin and origin of the Gan nationality, expounds the background and internal factors of the custom of marriage inheritance, and combs the concrete content of the custom of marriage inheritance. The second chapter, by summarizing the content of the first chapter, analyzes the current situation of the marriage inheritance custom of the security nationality, and compares the relationship between the marriage inheritance custom and the state law, mainly from the conflict between the two. On the basis of this, the possibility of coordination between the two is analyzed in order to cause the next chapter to think about the coordination path. The third chapter draws the conclusion through the analysis of the above chapters: through legislation, law enforcement, judicial three aspects, the national law should absorb the reasonable factors in the custom of marriage inheritance of the security nationality, and the security group itself should also make the change. In order to realize the harmonization of national law and national custom, the religious regulations should be added and abridged to conform to the unity of the country's rule of law.
