【摘要】：2001年《婚姻法》修正案完善了我國的結(jié)婚制度,增設(shè)了無效婚姻和可撤銷婚姻婚姻制度,但是我國的無效婚姻和可撤銷婚姻制度都是對在實(shí)體上不符合結(jié)婚要求的婚姻的處理,而對當(dāng)事人在婚姻登記程序上沒有完全按照法律的要求進(jìn)行,其婚姻登記能否產(chǎn)生相應(yīng)的法律后果,則尚未有明確的法律規(guī)定�，F(xiàn)實(shí)生活中因婚姻登記程序瑕疵而引發(fā)的糾紛時(shí)有出現(xiàn),卻難以得到妥善解決�；橐龅怯洺绦蜩Υ玫念愋秃托Я�,對婚姻登記程序瑕疵的出現(xiàn)該如何進(jìn)行防范和救濟(jì),這些都是應(yīng)當(dāng)進(jìn)行研究的問題。 本文運(yùn)用實(shí)證分析的方法對婚姻登記程序瑕疵的效力和救濟(jì)問題進(jìn)行探討,在結(jié)構(gòu)上主要分為四部分：第一部分通過介紹一個(gè)典型案例以及關(guān)于該案所涉及相關(guān)問題的主要觀點(diǎn),引出婚姻登記程序瑕疵的問題。第二部分主要是對婚姻登記程序瑕疵的概念、特征和類型進(jìn)行闡述說明。第三部分是對不同類型的登記程序瑕疵婚姻的效力進(jìn)行分析。第四部分主要是對婚姻登記程序瑕疵的救濟(jì)問題進(jìn)行探討,對于婚姻登記程序瑕疵的救濟(jì)方式,主要總結(jié)了行政撤銷、行政訴訟、民事訴訟這三種途徑,最終得出民事訴訟是目前較為適合的救濟(jì)途徑這一結(jié)論,建議通過婚姻成立與不成立之訴對婚姻登記程序瑕疵引發(fā)的糾紛進(jìn)行解決。并在文章最后建議可以通過建立婚姻公告制度來對婚姻登記程序瑕疵進(jìn)行防范。
[Abstract]:In 2001, the Marriage Law was amended to perfect the marriage system of our country, and to establish the system of invalid marriage and revocable marriage. However, the system of invalid marriage and revocable marriage in our country is to deal with the marriage which does not meet the requirement of marriage in entity. However, there are no clear legal provisions as to whether the registration of marriage can produce the corresponding legal consequences if the parties are not in accordance with the requirements of the law in the procedure of marriage registration. In real life, the disputes caused by the defect of marriage registration procedure appear, but it is difficult to be solved properly. The types and effects of defects in marriage registration procedures, and how to prevent and remedy the defects in marriage registration procedures are all problems that should be studied. This paper uses the method of empirical analysis to discuss the effectiveness and relief of defects in marriage registration procedure. The structure is divided into four parts: the first part introduces a typical case and the main points of view on the relevant issues involved in the case, leading to the defect of marriage registration procedure. The second part mainly explains the concept, characteristics and types of defects in marriage registration procedure. The third part is the analysis of the effectiveness of different registration procedures of defective marriage. The fourth part mainly discusses the remedy of the defect of the marriage registration procedure, and summarizes the three ways of the remedy of the defect of the marriage registration procedure, such as administrative revocation, administrative litigation, civil action, etc. Finally, it comes to the conclusion that civil action is a more suitable remedy at present. It is suggested that the dispute caused by the defect of marriage registration procedure be resolved through the litigation of marriage establishment and non-establishment. At the end of the article, it is suggested that the defects of marriage registration procedure can be prevented by establishing marriage announcement system.
